AMENDMENT TO HOUSE BILL 4868

2    AMENDMENT NO. ______. Amend House Bill 4868 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Nursing Home Care Act is amended by adding 
5Section 3-610.5 as follows:
 
6    (210 ILCS 45/3-610.5 new)
7    Sec. 3-610.5. Incident and accident reporting.  
8    (a) Each facility shall notify the Department of any 
9incident or accident that results in serious physical harm or 
10injury to a resident or any situation in which a resident 
11requires immediate medical attention, including admission to a 
12hospital, as a direct result of an incident or accident. 
13Nothing in this Section precludes reporting of suspected or 
14alleged abuse or neglect that must be reported according to 
15the Abused and Neglected Long Term Care Facility Residents 
16Reporting Act.

1    (b) Each facility shall, by phone, by fax, or through the 
2Office of Health Care Regulation LLCS Portal, notify the 
3appropriate regional office of the Department within 24 hours 
4after each reportable incident or accident. The facility shall 
5send a narrative summary of each reportable incident or 
6accident to the Department within 5 business days after the 
7incident or accident.".
