AMENDMENT TO SENATE BILL 3678

2    AMENDMENT NO. ______. Amend Senate Bill 3678 on page 1,
3line 5, by replacing "Section 1.5" with "Sections 1.5 and 2";
4and
 
5on page 19, by deleting line 12; and
 
6on page 19, immediately below line 13, by inserting the
7following:
 
8    "(815 ILCS 414/2)  (was 720 ILCS 375/2)
9    Sec. 2. (a) Whoever violates any of the provisions of
10Section 1.5 of this Act, except for subsections (f-10),
11(f-15), (f-20), (f-25), and (f-30) of Section 1.5, shall be
12guilty of a Class A misdemeanor and may be fined up to $5,000
13$5,000.00 for each offense, whoever violates subsections
14(f-10), (f-15), (f-20), (f-25), and (f-30) of Section 1.5 may
15be fined up to $5,000 for each offense, and whoever violates

1any other provision of this Act may be enjoined and be required
2to make restitution to all injured consumers upon application
3for injunctive relief by the State's Attorney or Attorney
4General and shall also be guilty of a Class A misdemeanor, and
5any owner, lessee, manager or trustee convicted under this Act
6shall, in addition to the penalty herein provided, forfeit the
7license of such theatre, circus, baseball park, or place of
8public entertainment or amusement so granted and the same
9shall be revoked by the authorities granting the same.
10    (b) Tickets sold or offered for sale by a person, firm or
11corporation in violation of Section 1.5 of this Act may be
12confiscated by a court on motion of the Attorney General, a
13State's Attorney, the sponsor of the event for which the
14tickets are being sold, or the owner or operator of the
15facility at which the event is to be held, and may be donated
16by order of the court to an appropriate organization as
17defined under Section 2 of the Charitable Games Act.
18    (c) The Attorney General, a State's Attorney, the sponsor
19of an event for which tickets are being sold, or the owner or
20operator of the facility at which an event is to be held may
21seek an injunction restraining any person, firm or corporation
22from selling or offering for sale tickets in violation of the
23provisions of this Act. In addition, on motion of the Attorney
24General, a State's Attorney, the sponsor of an event for which
25tickets are being sold, or the owner or operator of the
26facility at which an event is to be held, a court may

1permanently enjoin a person, firm or corporation found guilty
2of violating Section 1.5 of this Act from engaging in the offer
3or sale of tickets.
