| Amends the Environmental Protection Act. Deletes provisions requiring owners of underground storage tanks containing hazardous waste to register the tanks with the Illinois Environmental Protection Agency and provide the Agency with information concerning the contents of the tanks. Deletes a provision requiring the owners of registered tanks to notify the Agency of any change in registration information or of the removal the tank from service. |

1 | | AN ACT concerning safety. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Environmental Protection Act is amended by |
5 | | changing Section 22.12 as follows: |
6 | | (415 ILCS 5/22.12) (from Ch. 111 1/2, par. 1022.12) |
7 | | Sec. 22.12. (a) The Agency shall coordinate with the |
8 | | Office of the State Fire Marshal in the administration of the |
9 | | Leaking Underground Storage Tank program, as established in |
10 | | Subtitle I of the Hazardous and Solid Waste Amendments of 1984 |
11 | | (P.L. 98-616), as amended, of the Resource Conservation and |
12 | | Recovery Act of 1976 (P.L. 94-580). The Agency shall act as the |
13 | | lead agency in the formulation of regulations and policies, |
14 | | and shall be responsible for groundwater monitoring and any |
15 | | necessary site cleanup requirements encountered under the |
16 | | Resource Conservation and Recovery Act of 1976, the |
17 | | Comprehensive Environmental Response Compensation and |
18 | | Liability Act, or the State "Clean Illinois" program. |
19 | | (b) By May 8, 1986, a person who is the owner of an |
20 | | underground storage tank containing hazardous waste on July 1, |
21 | | 1986 shall register the tank with the Agency on the form |
22 | | provided by the Agency pursuant to Subtitle I of The Hazardous |
23 | | and Solid Waste Amendments of 1984 (P.L. 98-616) of the |
