1 | | that propel an electric vehicle. "Electric vehicle battery" |
2 | | includes, but is not limited to, lithium-ion batteries and |
3 | | nickel-metal hydride batteries. |
4 | | "Used battery" means an EV battery that is sold, given, or |
5 | | otherwise conveyed to a battery storage site. |
6 | | "Storage" means any accumulation of used batteries that |
7 | | does not constitute disposal. |
8 | | (b) No person shall cause or allow the operation of a |
9 | | battery storage site at which 5,000 kilograms or more of used |
10 | | batteries are stored at any one time unless: |
11 | | (1) the battery storage site is registered with the |
12 | | Agency in accordance with this Section; |
13 | | (2) the owner or operator of the battery storage site |
14 | | maintains records documenting the following: |
15 | | (A) the weight or volume of whole or partial used |
16 | | batteries received at the battery storage site each |
17 | | week; |
18 | | (B) the weight or volume of whole or partial used |
19 | | batteries leaving the battery storage site each week; |
20 | | and |
21 | | (C) the weight or volume of whole or partial used |
22 | | batteries remaining at the battery storage site at the |
23 | | end of each week; and |
24 | | (3) the owner or operator of the battery storage site |
25 | | is an automotive parts recycler as defined in Section |
26 | | 1-105.3 of the Illinois Vehicle Code and licensed under |

1 | | Section 5-301 of the Illinois Vehicle Code. |
2 | | The records required under this Section shall be made |
3 | | available for inspection and copying by the Agency during the |
4 | | normal business hours. |
5 | | (c) The owner or operator of each battery storage site in |
6 | | operation prior to February 1, 2026, at which 5,000 kilograms |
7 | | or more of used batteries are stored at any one time, must |
8 | | register with the Agency prior to February 1, 2026 and each |
9 | | February 1 thereafter. Any owners or operators of a battery |
10 | | storage site that comes into operation after February 1, 2026 |
11 | | shall register with the Agency prior to commencing operation. |
12 | | Registration must be on forms and in a format prescribed by the |
13 | | Agency. Agency registration forms shall include, at a minimum, |
14 | | information regarding the following: |
15 | | (1) the name and address of the owner and operator of |
16 | | the battery storage site; |
17 | | (2) A description of the operations conducted at the |
18 | | battery storage site; |
19 | | (3) the weight or volume of whole or partial used |
20 | | batteries received at the battery storage site over the |
21 | | past calendar year; and |
22 | | (4) the weight or volume of whole or partial used |
23 | | batteries at the battery storage site at the end of the |
24 | | calendar year. |
25 | | (d) No later than 1 year after the effective date of this |
26 | | amendatory Act, the Agency shall propose to the Board, and no |

1 | | later than one year after receipt of the Agency's proposal, |
2 | | the Board shall adopt, rules for the operation of battery |
3 | | storage sites. Such rules shall include, but not be limited |
4 | | to: requirements for end-of-life battery receipt, handling, |
5 | | storage, and transfer; standards for fire prevention; |
6 | | requirements for contingency planning and emergency response; |
7 | | recordkeeping; reporting; and financial assurance. |
