SYNOPSIS AS INTRODUCED:
 
New Act
775 ILCS 5/6-102

    Creates the Censorship in Correctional Facilities Act. Provides that a law enforcement agency or law enforcement official shall not refuse to approve the use or prohibit the use of books, including, but not limited to, memoirs, autobiographies, and biographies, based upon the depiction in those materials of matters related to the protected characteristics or categories identified in the Illinois Human Rights Act in any correctional facility in the State. Defines terms. Makes corresponding changes.

1    AN ACT concerning correctional facilities.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Censorship in Correctional Facilities Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Law enforcement agency" means an agency of the State or
8of a unit of local government charged with enforcement of
9State, county, or municipal laws or with managing custody of
10detained persons in the State.
11    "Law enforcement official" means any individual with the
12power to arrest or detain individuals, including law
13enforcement officers, corrections officers, and others
14employed or designated by a law enforcement agency. "Law
15enforcement official" includes a probation officer.
 
16    Section 10. Censorship or book bans prohibited. A law
17enforcement agency or law enforcement official shall not
18refuse to approve the use or prohibit the use of books,
19including, but not limited to, memoirs, autobiographies, and
20biographies, based upon the depiction in those materials of
21matters related to the protected characteristics or categories
22identified in subsection (Q) of Section 1-103 of the Illinois

1Human Rights Act in any correctional facility in the State.
 
2    Section 15. The Illinois Human Rights Act is amended by
3changing Section 6-102 as follows:

5    Sec. 6-102. Violations of other Acts. A person who
6violates Section 11-117-12.2 of the Illinois Municipal Code,
7Section 224.05 of the Illinois Insurance Code, Section 8-201.5
8of the Public Utilities Act, Sections 2-1401.1, 9-107.10,
99-107.11, and 15-1501.6 of the Code of Civil Procedure,
10Section 4.05 of the Interest Act, the Military Personnel
11Cellular Phone Contract Termination Act, Section 405-272 of
12the Civil Administrative Code of Illinois, Section 10-63 of
13the Illinois Administrative Procedure Act, Sections 30.25 and
1430.30 of the Military Code of Illinois, Section 16 of the
15Landlord and Tenant Act, Section 26.5 of the Retail
16Installment Sales Act, Section 10 of the Censorship in
17Correctional Facilities Act, or Section 37 of the Motor
18Vehicle Leasing Act commits a civil rights violation within
19the meaning of this Act.
