2023 and 2024 SB3281 Introduced 2/7/2024, by Sen. Sara Feigenholtz SYNOPSIS AS INTRODUCED: | | | Amends the State Employees Group Insurance Act of 1971. Provides that if a prescription drug approved by the federal Food and Drug Administration for the treatment of a mental illness is removed or substituted on the drug formulary and that prescription drug has been prescribed to an employee, retired employee, annuitant, or beneficiary covered under the Act and has been successfully treating the employee, retired employee, annuitant, or beneficiary for 6 or more months, the program of health benefits shall continue to provide coverage to that individual for that prescription drug as though the prescription drug had not been removed or substituted on the drug formulary. |

1 | | AN ACT concerning State government. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The State Employees Group Insurance Act of 1971 |
5 | | is amended by adding Section 6.17 as follows: |
6 | | (5 ILCS 375/6.17 new) |
7 | | Sec. 6.17. Prescription drugs; mental illness. If a |
8 | | prescription drug approved by the federal Food and Drug |
9 | | Administration for the treatment of a mental illness is |
10 | | removed or substituted on the drug formulary and that |
11 | | prescription drug has been prescribed to an employee, retired |
12 | | employee, annuitant, or beneficiary covered under this Act and |
13 | | has been successfully treating the employee, retired employee, |
14 | | annuitant, or beneficiary for 6 or more months, the program of |
15 | | health benefits shall continue to provide coverage to that |
16 | | individual for that prescription drug as though the |
17 | | prescription drug had not been removed or substituted on the |
18 | | drug formulary. |
