    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall establish a program to train EMS personnel, State police officers, and law enforcement officers to access a cell phone's medical identification or medical information application. Amends the Illinois State Police Law of the Civil Administrative Code of Illinois and the Illinois Police Training Act providing that the State police officers and law enforcement officers are required to participate in the in-service training established by the Department of Public Health for training in accessing a cell phone's medical identification or medical information application. Effective January 1, 2025.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-711 as follows:
 
7    (20 ILCS 2310/2310-711 new)
8    Sec. 2310-711. Training; cell phone medical information.
9The Department shall establish a program to train EMS
10personnel, as that term is defined in Section 3.5 of the
11Emergency Medical Services (EMS) Systems Act, State police
12officers, and law enforcement officers to access a cell
13phone's medical identification or medical information
14application.
 
15    Section 10. The Illinois State Police Law of the Civil
16Administrative Code of Illinois is amended by changing Section
172605-51 as follows:

19    Sec. 2605-51. Division of the Academy and Training.
20    (a) The Division of the Academy and Training shall
21exercise, but not be limited to, the following functions:

1        (1) Oversee and operate the Illinois State Police
2    Training Academy.
3        (2) Train and prepare new officers for a career in law
4    enforcement, with innovative, quality training and
5    educational practices.
6        (3) Offer continuing training and educational programs
7    for Illinois State Police employees.
8        (4) Oversee the Illinois State Police's recruitment
9    initiatives.
10        (5) Oversee and operate the Illinois State Police's
11    quartermaster.
12        (6) Duties assigned to the Illinois State Police in
13    Article 5, Chapter 11 of the Illinois Vehicle Code
14    concerning testing and training officers on the detection
15    of impaired driving.
16        (7) Duties assigned to the Illinois State Police in
17    Article 108B of the Code of Criminal Procedure.
18    (a-5) Successful completion of the Illinois State Police
19Academy satisfies the minimum standards pursuant to
20subsections (a), (b), and (d) of Section 7 of the Illinois
21Police Training Act and exempts State police officers from the
22Illinois Law Enforcement Training Standards Board's State
23Comprehensive Examination and Equivalency Examination.
24Satisfactory completion shall be evidenced by a commission or
25certificate issued to the officer.
26    (b) The Division of the Academy and Training shall

1exercise the rights, powers, and duties vested in the former
2Division of State Troopers by Section 17 of the Illinois State
3Police Act.
4    (c) Specialized training.
5        (1) Training; cultural diversity. The Division of the
6    Academy and Training shall provide training and continuing
7    education to State police officers concerning cultural
8    diversity, including sensitivity toward racial and ethnic
9    differences. This training and continuing education shall
10    include, but not be limited to, an emphasis on the fact
11    that the primary purpose of enforcement of the Illinois
12    Vehicle Code is safety and equal and uniform enforcement
13    under the law.
14        (2) Training; death and homicide investigations. The
15    Division of the Academy and Training shall provide
16    training in death and homicide investigation for State
17    police officers. Only State police officers who
18    successfully complete the training may be assigned as lead
19    investigators in death and homicide investigations.
20    Satisfactory completion of the training shall be evidenced
21    by a certificate issued to the officer by the Division of
22    the Academy and Training. The Director shall develop a
23    process for waiver applications for officers whose prior
24    training and experience as homicide investigators may
25    qualify them for a waiver. The Director may issue a
26    waiver, at his or her discretion, based solely on the

1    prior training and experience of an officer as a homicide
2    investigator.
3            (A) The Division shall require all homicide
4        investigator training to include instruction on
5        victim-centered, trauma-informed investigation. This
6        training must be implemented by July 1, 2023.
7            (B) The Division shall cooperate with the Division
8        of Criminal Investigation to develop a model
9        curriculum on victim-centered, trauma-informed
10        investigation. This curriculum must be implemented by
11        July 1, 2023.
12        (3) Training; police dog training standards. All
13    police dogs used by the Illinois State Police for drug
14    enforcement purposes pursuant to the Cannabis Control Act,
15    the Illinois Controlled Substances Act, and the
16    Methamphetamine Control and Community Protection Act shall
17    be trained by programs that meet the certification
18    requirements set by the Director or the Director's
19    designee. Satisfactory completion of the training shall be
20    evidenced by a certificate issued by the Division of the
21    Academy and Training.
22        (4) Training; post-traumatic stress disorder. The
23    Division of the Academy and Training shall conduct or
24    approve a training program in post-traumatic stress
25    disorder for State police officers. The purpose of that
26    training shall be to equip State police officers to

1    identify the symptoms of post-traumatic stress disorder
2    and to respond appropriately to individuals exhibiting
3    those symptoms.
4        (5) Training; opioid antagonists. The Division of the
5    Academy and Training shall conduct or approve a training
6    program for State police officers in the administration of
7    opioid antagonists as defined in paragraph (1) of
8    subsection (e) of Section 5-23 of the Substance Use
9    Disorder Act that is in accordance with that Section. As
10    used in this Section, "State police officers" includes
11    full-time or part-time State police officers,
12    investigators, and any other employee of the Illinois
13    State Police exercising the powers of a peace officer.
14        (6) Training; sexual assault and sexual abuse.
15            (A) Every 3 years, the Division of the Academy and
16        Training shall present in-service training on sexual
17        assault and sexual abuse response and report writing
18        training requirements, including, but not limited to,
19        the following:
20                (i) recognizing the symptoms of trauma;
21                (ii) understanding the role trauma has played
22            in a victim's life;
23                (iii) responding to the needs and concerns of
24            a victim;
25                (iv) delivering services in a compassionate,
26            sensitive, and nonjudgmental manner;

1                (v) interviewing techniques in accordance with
2            the curriculum standards in this paragraph (6);
3                (vi) understanding cultural perceptions and
4            common myths of sexual assault and sexual abuse;
5            and
6                (vii) report writing techniques in accordance
7            with the curriculum standards in this paragraph
8            (6).
9            (B) This training must also be presented in all
10        full and part-time basic law enforcement academies.
11            (C) Instructors providing this training shall have
12        successfully completed training on evidence-based,
13        trauma-informed, victim-centered responses to cases of
14        sexual assault and sexual abuse and have experience
15        responding to sexual assault and sexual abuse cases.
16            (D) The Illinois State Police shall adopt rules,
17        in consultation with the Office of the Attorney
18        General and the Illinois Law Enforcement Training
19        Standards Board, to determine the specific training
20        requirements for these courses, including, but not
21        limited to, the following:
22                (i) evidence-based curriculum standards for
23            report writing and immediate response to sexual
24            assault and sexual abuse, including
25            trauma-informed, victim-centered interview
26            techniques, which have been demonstrated to

1            minimize retraumatization, for all State police
2            officers; and
3                (ii) evidence-based curriculum standards for
4            trauma-informed, victim-centered investigation
5            and interviewing techniques, which have been
6            demonstrated to minimize retraumatization, for
7            cases of sexual assault and sexual abuse for all
8            State police officers who conduct sexual assault
9            and sexual abuse investigations.
10        (7) Training; human trafficking. The Division of the
11    Academy and Training shall conduct or approve a training
12    program in the detection and investigation of all forms of
13    human trafficking, including, but not limited to,
14    involuntary servitude under subsection (b) of Section 10-9
15    of the Criminal Code of 2012, involuntary sexual servitude
16    of a minor under subsection (c) of Section 10-9 of the
17    Criminal Code of 2012, and trafficking in persons under
18    subsection (d) of Section 10-9 of the Criminal Code of
19    2012. This program shall be made available to all cadets
20    and State police officers.
21        (8) Training; hate crimes. The Division of the Academy
22    and Training shall provide training for State police
23    officers in identifying, responding to, and reporting all
24    hate crimes.
25        (9) Training; cell phone medical information. The
26    Division of the Academy and Training shall require each

1    State police officer to participate in the training
2    program established by the Department of Public Health
3    under Section 2310-711 of the Department of Public Health
4    Powers and Duties Law of the Civil Administrative Code of
5    Illinois.
6    (d) The Division of the Academy and Training shall
7administer and conduct a program consistent with 18 U.S.C.
8926B and 926C for qualified active and retired Illinois State
9Police officers.

12    Section 15. The Illinois Police Training Act is amended by
13adding Section 10.25 as follows:
 
14    (50 ILCS 705/10.25 new)
15    Sec. 10.25. Training; cell phone medical information. The
16Board shall require each law enforcement officer to
17participate in the training program established by the
18Department of Public Health under Section 2310-711 of the
19Department of Public Health Powers and Duties Law of the Civil
20Administrative Code of Illinois.
 
21    Section 99. Effective date. This Act takes effect January
221, 2025.
