1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 4 and 12 as follows:

8    Sec. 4. Identification card.
9    (a) The Secretary of State shall issue a standard Illinois
10Identification Card to any natural person who is a resident of
11the State of Illinois who applies for such card, or renewal
12thereof. No identification card shall be issued to any person
13who holds a valid foreign state identification card, license,
14or permit unless the person first surrenders to the Secretary
15of State the valid foreign state identification card, license,
16or permit. The card shall be prepared and supplied by the
17Secretary of State and shall include a photograph and
18signature or mark of the applicant. However, the Secretary of
19State may provide by rule for the issuance of Illinois
20Identification Cards without photographs if the applicant has
21a bona fide religious objection to being photographed or to
22the display of his or her photograph. The Illinois
23Identification Card may be used for identification purposes in

1any lawful situation only by the person to whom it was issued.
2As used in this Act, "photograph" means any color photograph
3or digitally produced and captured image of an applicant for
4an identification card. As used in this Act, "signature" means
5the name of a person as written by that person and captured in
6a manner acceptable to the Secretary of State.
7    (a-5) If an applicant for an identification card has a
8current driver's license or instruction permit issued by the
9Secretary of State, the Secretary may require the applicant to
10utilize the same residence address and name on the
11identification card, driver's license, and instruction permit
12records maintained by the Secretary. The Secretary may
13promulgate rules to implement this provision.
14    (a-10) If the applicant is a judicial officer as defined
15in Section 1-10 of the Judicial Privacy Act or a peace officer,
16the applicant may elect to have his or her office or work
17address listed on the card instead of the applicant's
18residence or mailing address. The Secretary may promulgate
19rules to implement this provision. For the purposes of this
20subsection (a-10), "peace officer" means any person who by
21virtue of his or her office or public employment is vested by
22law with a duty to maintain public order or to make arrests for
23a violation of any penal statute of this State, whether that
24duty extends to all violations or is limited to specific
25violations.
26    (a-15) The Secretary of State may provide for an expedited

1process for the issuance of an Illinois Identification Card.
2The Secretary shall charge an additional fee for the expedited
3issuance of an Illinois Identification Card, to be set by
4rule, not to exceed $75. All fees collected by the Secretary
5for expedited Illinois Identification Card service shall be
6deposited into the Secretary of State Special Services Fund.
7The Secretary may adopt rules regarding the eligibility,
8process, and fee for an expedited Illinois Identification
9Card. If the Secretary of State determines that the volume of
10expedited identification card requests received on a given day
11exceeds the ability of the Secretary to process those requests
12in an expedited manner, the Secretary may decline to provide
13expedited services, and the additional fee for the expedited
14service shall be refunded to the applicant.
15    (a-20) The Secretary of State shall issue a standard
16Illinois Identification Card to a person committed to the
17Department of Corrections, the or Department of Juvenile
18Justice, a Federal Bureau of Prisons facility located in
19Illinois, or a county jail or county department of corrections
20as follows: upon receipt of the person's birth certificate,
21social security card, photograph, proof of residency upon
22discharge, and an identification card application transferred
23via a secure method as agreed upon by the Secretary and the
24Department of Corrections or Department of Juvenile Justice.
25Illinois residency shall be established by submission of a
26Secretary of State prescribed Identification Card verification

1form completed by the respective Department.
2        (1) A committed person who has previously held an
3    Illinois Identification Card or an Illinois driver's
4    license shall submit an Identification Card verification
5    form to the Secretary of State, including a photograph
6    taken by the correctional facility, proof of residency
7    upon discharge, and a social security number, if the
8    committed person has a social security number. If the
9    committed person does not have a social security number
10    and is eligible for a social security number, the
11    Secretary of State shall not issue a standard Illinois
12    Identification Card until the committed person obtains a
13    social security number. If the committed person's
14    photograph and demographic information matches an existing
15    Illinois Identification Card or Illinois driver's license
16    and the Secretary of State verifies the applicant's social
17    security number with the Social Security Administration,
18    the Secretary of State shall issue the committed person a
19    standard Illinois Identification Card. If the photograph
20    or demographic information matches an existing Illinois
21    Identification Card or Illinois driver's license in
22    another person's name or identity, a standard Illinois
23    Identification Card shall not be issued until the
24    committed person submits a certified birth certificate and
25    social security card to the Secretary of State and the
26    Secretary of State verifies the identity of the committed

1    person. If the Secretary of State cannot find a match to an
2    existing Illinois Identification Card or Illinois driver's
3    license, the committed person may apply for a standard
4    Illinois Identification card as described in paragraph
5    (2).
6        (2) A committed person who has not previously held an
7    Illinois Identification Card or Illinois driver's license
8    or for whom a match cannot be found as described in
9    paragraph (1) shall submit an Identification Card
10    verification form, including a photograph taken by the
11    correctional facility, a certified birth certificate,
12    proof of residency upon discharge, and a social security
13    number, if the committed has a social security number. If
14    the committed person does not have a social security
15    number and is eligible for a social security number, the
16    Secretary of State shall not issue a standard Illinois
17    Identification Card until the committed person obtains a
18    social security number. If the Secretary of State verifies
19    the applicant's social security number with the Social
20    Security Administration, the Secretary of State shall
21    issue the committed person a standard Illinois
22    Identification Card.
23    The Illinois Identification Card verification form
24described in this subsection shall be prescribed by the
25Secretary State. The Secretary of State and correctional
26facilities in this State shall establish a secure method to

1transfer the form.
2    (a-25) The Secretary of State shall issue a limited-term
3Illinois Identification Card valid for 90 days to a committed
4person upon release on parole, mandatory supervised release,
5aftercare release, final discharge, or pardon from the
6Department of Corrections, the or Department of Juvenile
7Justice, a Federal Bureau of Prisons facility located in
8Illinois, or a county jail or county department of
9corrections, if the released person does not obtain a standard
10Illinois Identification Card as described in subsection (a-20)
11prior to release is unable to present a certified copy of his
12or her birth certificate and social security card or other
13documents authorized by the Secretary, but does present a
14Secretary of State prescribed Identification Card verification
15form completed by the correctional facility Department of
16Corrections or Department of Juvenile Justice, verifying the
17released person's date of birth, social security number, if
18the person has a social security number, and his or her
19Illinois residence address. The verification form must have
20been completed no more than 30 days prior to the date of
21application for the Illinois Identification Card.
22    Prior to the expiration of the 90-day period of the
23limited-term Illinois Identification Card, if the released
24person submits to the Secretary of State a certified copy of
25his or her birth certificate and his or her social security
26card or other documents authorized by the Secretary, a

1standard Illinois Identification Card shall be issued. A
2limited-term Illinois Identification Card may not be renewed.
3    This subsection shall not apply to a released person who
4was unable to obtain a standard Illinois Identification Card
5because his or her photograph or demographic information
6matched an existing Illinois Identification Card or Illinois
7driver's license in another person's name or identity or to a
8released person who does not have a social security number and
9is eligible for a social security number.
10    (a-30) The Secretary of State shall issue a standard
11Illinois Identification Card to a person upon conditional
12release or absolute discharge from the custody of the
13Department of Human Services, if the person presents a
14certified copy of his or her birth certificate, social
15security card, or other documents authorized by the Secretary,
16and a document proving his or her Illinois residence address.
17The Secretary of State shall issue a standard Illinois
18Identification Card to a person prior to his or her
19conditional release or absolute discharge if personnel from
20the Department of Human Services bring the person to a
21Secretary of State location with the required documents.
22Documents proving residence address may include any official
23document of the Department of Human Services showing the
24person's address after release and a Secretary of State
25prescribed verification form, which may be executed by
26personnel of the Department of Human Services.

1    (a-35) The Secretary of State shall issue a limited-term
2Illinois Identification Card valid for 90 days to a person
3upon conditional release or absolute discharge from the
4custody of the Department of Human Services, if the person is
5unable to present a certified copy of his or her birth
6certificate and social security card or other documents
7authorized by the Secretary, but does present a Secretary of
8State prescribed verification form completed by the Department
9of Human Services, verifying the person's date of birth and
10social security number, and a document proving his or her
11Illinois residence address. The verification form must have
12been completed no more than 30 days prior to the date of
13application for the Illinois Identification Card. The
14Secretary of State shall issue a limited-term Illinois
15Identification Card to a person no sooner than 14 days prior to
16his or her conditional release or absolute discharge if
17personnel from the Department of Human Services bring the
18person to a Secretary of State location with the required
19documents. Documents proving residence address shall include
20any official document of the Department of Human Services
21showing the person's address after release and a Secretary of
22State prescribed verification form, which may be executed by
23personnel of the Department of Human Services.
24    (b) The Secretary of State shall issue a special Illinois
25Identification Card, which shall be known as an Illinois
26Person with a Disability Identification Card, to any natural

1person who is a resident of the State of Illinois, who is a
2person with a disability as defined in Section 4A of this Act,
3who applies for such card, or renewal thereof. No Illinois
4Person with a Disability Identification Card shall be issued
5to any person who holds a valid foreign state identification
6card, license, or permit unless the person first surrenders to
7the Secretary of State the valid foreign state identification
8card, license, or permit. The Secretary of State shall charge
9no fee to issue such card. The card shall be prepared and
10supplied by the Secretary of State, and shall include a
11photograph and signature or mark of the applicant, a
12designation indicating that the card is an Illinois Person
13with a Disability Identification Card, and shall include a
14comprehensible designation of the type and classification of
15the applicant's disability as set out in Section 4A of this
16Act. However, the Secretary of State may provide by rule for
17the issuance of Illinois Person with a Disability
18Identification Cards without photographs if the applicant has
19a bona fide religious objection to being photographed or to
20the display of his or her photograph. If the applicant so
21requests, the card shall include a description of the
22applicant's disability and any information about the
23applicant's disability or medical history which the Secretary
24determines would be helpful to the applicant in securing
25emergency medical care. If a mark is used in lieu of a
26signature, such mark shall be affixed to the card in the

1presence of two witnesses who attest to the authenticity of
2the mark. The Illinois Person with a Disability Identification
3Card may be used for identification purposes in any lawful
4situation by the person to whom it was issued.
5    The Illinois Person with a Disability Identification Card
6may be used as adequate documentation of disability in lieu of
7a physician's determination of disability, a determination of
8disability from a physician assistant, a determination of
9disability from an advanced practice registered nurse, or any
10other documentation of disability whenever any State law
11requires that a person with a disability provide such
12documentation of disability, however an Illinois Person with a
13Disability Identification Card shall not qualify the
14cardholder to participate in any program or to receive any
15benefit which is not available to all persons with like
16disabilities. Notwithstanding any other provisions of law, an
17Illinois Person with a Disability Identification Card, or
18evidence that the Secretary of State has issued an Illinois
19Person with a Disability Identification Card, shall not be
20used by any person other than the person named on such card to
21prove that the person named on such card is a person with a
22disability or for any other purpose unless the card is used for
23the benefit of the person named on such card, and the person
24named on such card consents to such use at the time the card is
25so used.

1under Section 4A of this Act is acceptable as documentation
2for the purpose of issuing an Illinois Person with a
3Disability Identification Card.
4    When medical information is contained on an Illinois
5Person with a Disability Identification Card, the Office of
6the Secretary of State shall not be liable for any actions
7taken based upon that medical information.
8    (c) The Secretary of State shall provide that each
9original or renewal Illinois Identification Card or Illinois
10Person with a Disability Identification Card issued to a
11person under the age of 21 shall be of a distinct nature from
12those Illinois Identification Cards or Illinois Person with a
13Disability Identification Cards issued to individuals 21 years
14of age or older. The color designated for Illinois
15Identification Cards or Illinois Person with a Disability
16Identification Cards for persons under the age of 21 shall be
17at the discretion of the Secretary of State.
18    (c-1) Each original or renewal Illinois Identification
19Card or Illinois Person with a Disability Identification Card
20issued to a person under the age of 21 shall display the date
21upon which the person becomes 18 years of age and the date upon
22which the person becomes 21 years of age.
23    (c-3) The General Assembly recognizes the need to identify
24military veterans living in this State for the purpose of
25ensuring that they receive all of the services and benefits to
26which they are legally entitled, including healthcare,

1education assistance, and job placement. To assist the State
2in identifying these veterans and delivering these vital
3services and benefits, the Secretary of State is authorized to
4issue Illinois Identification Cards and Illinois Person with a
5Disability Identification Cards with the word "veteran"
6appearing on the face of the cards. This authorization is
7predicated on the unique status of veterans. The Secretary may
8not issue any other identification card which identifies an
9occupation, status, affiliation, hobby, or other unique
10characteristics of the identification card holder which is
11unrelated to the purpose of the identification card.
12    (c-5) Beginning on or before July 1, 2015, the Secretary
13of State shall designate a space on each original or renewal
14identification card where, at the request of the applicant,
15the word "veteran" shall be placed. The veteran designation
16shall be available to a person identified as a veteran under
17subsection (b) of Section 5 of this Act who was discharged or
18separated under honorable conditions.
19    (d) The Secretary of State may issue a Senior Citizen
20discount card, to any natural person who is a resident of the
21State of Illinois who is 60 years of age or older and who
22applies for such a card or renewal thereof. The Secretary of
23State shall charge no fee to issue such card. The card shall be
24issued in every county and applications shall be made
25available at, but not limited to, nutrition sites, senior
26citizen centers and Area Agencies on Aging. The applicant,

1upon receipt of such card and prior to its use for any purpose,
2shall have affixed thereon in the space provided therefor his
3signature or mark.
4    (e) The Secretary of State, in his or her discretion, may
5designate on each Illinois Identification Card or Illinois
6Person with a Disability Identification Card a space where the
7card holder may place a sticker or decal, issued by the
8Secretary of State, of uniform size as the Secretary may
9specify, that shall indicate in appropriate language that the
10card holder has renewed his or her Illinois Identification
11Card or Illinois Person with a Disability Identification Card.

2address shall include any official document of the Department
3of Human Services showing the person's address after release
4and a Secretary of State prescribed verification form, which
5may be executed by personnel of the Department of Human
6Services.
7    (b) The Secretary of State shall issue a special Illinois
8Identification Card, which shall be known as an Illinois
9Person with a Disability Identification Card, to any natural
10person who is a resident of the State of Illinois, who is a
11person with a disability as defined in Section 4A of this Act,
12who applies for such card, or renewal thereof. No Illinois
13Person with a Disability Identification Card shall be issued
14to any person who holds a valid foreign state identification
15card, license, or permit unless the person first surrenders to
16the Secretary of State the valid foreign state identification
17card, license, or permit. The Secretary of State shall charge
18no fee to issue such card. The card shall be prepared and
19supplied by the Secretary of State, and shall include a
20photograph and signature or mark of the applicant, a
21designation indicating that the card is an Illinois Person
22with a Disability Identification Card, and shall include a
23comprehensible designation of the type and classification of
24the applicant's disability as set out in Section 4A of this
25Act. However, the Secretary of State may provide by rule for
26the issuance of Illinois Person with a Disability

1Identification Cards without photographs if the applicant has
2a bona fide religious objection to being photographed or to
3the display of his or her photograph. If the applicant so
4requests, the card shall include a description of the
5applicant's disability and any information about the
6applicant's disability or medical history which the Secretary
7determines would be helpful to the applicant in securing
8emergency medical care. If a mark is used in lieu of a
9signature, such mark shall be affixed to the card in the
10presence of two witnesses who attest to the authenticity of
11the mark. The Illinois Person with a Disability Identification
12Card may be used for identification purposes in any lawful
13situation by the person to whom it was issued.
14    The Illinois Person with a Disability Identification Card
15may be used as adequate documentation of disability in lieu of
16a physician's determination of disability, a determination of
17disability from a physician assistant, a determination of
18disability from an advanced practice registered nurse, or any
19other documentation of disability whenever any State law
20requires that a person with a disability provide such
21documentation of disability, however an Illinois Person with a
22Disability Identification Card shall not qualify the
23cardholder to participate in any program or to receive any
24benefit which is not available to all persons with like
25disabilities. Notwithstanding any other provisions of law, an
26Illinois Person with a Disability Identification Card, or

1evidence that the Secretary of State has issued an Illinois
2Person with a Disability Identification Card, shall not be
3used by any person other than the person named on such card to
4prove that the person named on such card is a person with a
5disability or for any other purpose unless the card is used for
6the benefit of the person named on such card, and the person
7named on such card consents to such use at the time the card is
8so used.
9    An optometrist's determination of a visual disability
10under Section 4A of this Act is acceptable as documentation
11for the purpose of issuing an Illinois Person with a
12Disability Identification Card.
13    When medical information is contained on an Illinois
14Person with a Disability Identification Card, the Office of
15the Secretary of State shall not be liable for any actions
16taken based upon that medical information.
17    (c) The Secretary of State shall provide that each
18original or renewal Illinois Identification Card or Illinois
19Person with a Disability Identification Card issued to a
20person under the age of 21 shall be of a distinct nature from
21those Illinois Identification Cards or Illinois Person with a
22Disability Identification Cards issued to individuals 21 years
23of age or older. The color designated for Illinois
24Identification Cards or Illinois Person with a Disability
25Identification Cards for persons under the age of 21 shall be
26at the discretion of the Secretary of State.

1    (c-1) Each original or renewal Illinois Identification
2Card or Illinois Person with a Disability Identification Card
3issued to a person under the age of 21 shall display the date
4upon which the person becomes 18 years of age and the date upon
5which the person becomes 21 years of age.
6    (c-3) The General Assembly recognizes the need to identify
7military veterans living in this State for the purpose of
8ensuring that they receive all of the services and benefits to
9which they are legally entitled, including healthcare,
10education assistance, and job placement. To assist the State
11in identifying these veterans and delivering these vital
12services and benefits, the Secretary of State is authorized to
13issue Illinois Identification Cards and Illinois Person with a
14Disability Identification Cards with the word "veteran"
15appearing on the face of the cards. This authorization is
16predicated on the unique status of veterans. The Secretary may
17not issue any other identification card which identifies an
18occupation, status, affiliation, hobby, or other unique
19characteristics of the identification card holder which is
20unrelated to the purpose of the identification card.
21    (c-5) Beginning on or before July 1, 2015, the Secretary
22of State shall designate a space on each original or renewal
23identification card where, at the request of the applicant,
24the word "veteran" shall be placed. The veteran designation
25shall be available to a person identified as a veteran under
26subsection (b) of Section 5 of this Act who was discharged or

1separated under honorable conditions.
2    (d) The Secretary of State may issue a Senior Citizen
3discount card, to any natural person who is a resident of the
4State of Illinois who is 60 years of age or older and who
5applies for such a card or renewal thereof. The Secretary of
6State shall charge no fee to issue such card. The card shall be
7issued in every county and applications shall be made
8available at, but not limited to, nutrition sites, senior
9citizen centers and Area Agencies on Aging. The applicant,
10upon receipt of such card and prior to its use for any purpose,
11shall have affixed thereon in the space provided therefor his
12signature or mark.
13    (e) The Secretary of State, in his or her discretion, may
14designate on each Illinois Identification Card or Illinois
15Person with a Disability Identification Card a space where the
16card holder may place a sticker or decal, issued by the
17Secretary of State, of uniform size as the Secretary may
18specify, that shall indicate in appropriate language that the
19card holder has renewed his or her Illinois Identification
20Card or Illinois Person with a Disability Identification Card.

21affirmation by the applicant on a form provided by the
22Secretary of State, that such person resides in a veterans
23home or veterans hospital operated by the State or federal
24government.
25    The application of a homeless individual for an Illinois
26Identification Card to be issued at no fee must be accompanied

1by an affirmation by a qualified person, as defined in Section
24C of this Act, on a form provided by the Secretary of State,
3that the applicant is currently homeless as defined in Section
41A of this Act.
5    For the application for the first Illinois Identification
6Card of a youth for whom the Department of Children and Family
7Services is legally responsible or a foster child to be issued
8at no fee, the youth must submit, along with the application,
9an affirmation by his or her court appointed attorney or an
10employee of the Department of Children and Family Services on
11a form provided by the Secretary of State, that the person is a
12youth for whom the Department of Children and Family Services
13is legally responsible or a foster child.
14    The fee for any duplicate identification card shall be
15waived for any person who presents the Secretary of State's
16Office with a police report showing that his or her
17identification card was stolen.
18    The fee for any duplicate identification card shall be
19waived for any person age 60 or older whose identification
20card has been lost or stolen.
21    As used in this Section, "active-duty member of the United
22States Armed Forces" means a member of the Armed Services or
23Reserve Forces of the United States or a member of the Illinois
24National Guard who is called to active duty pursuant to an
25executive order of the President of the United States, an act
26of the Congress of the United States, or an order of the

5    Section 95. No acceleration or delay. Where this Act makes
6changes in a statute that is represented in this Act by text
7that is not yet or no longer in effect (for example, a Section
8represented by multiple versions), the use of that text does
9not accelerate or delay the taking effect of (i) the changes
10made by this Act or (ii) provisions derived from any other
11Public Act.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
