AMENDMENT TO SENATE BILL 2238

2    AMENDMENT NO. ______. Amend Senate Bill 2238 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing
5Sections 10-22.23 and 14-1.09 as follows:
 
6    (105 ILCS 5/10-22.23)  (from Ch. 122, par. 10-22.23)
7    Sec. 10-22.23. School Nurse. To employ a registered
8professional nurse and define the duties of the school nurse
9within the guidelines of rules and regulations promulgated by
10the State Board of Education. Any school nurse first employed
11on or after July 1, 1976, whose duties require teaching or the
12exercise of instructional judgment or educational evaluation
13of pupils, must be licensed under Section 21B-25 of this Code.
14School districts may employ nonlicensed registered
15professional nurses to perform professional nursing services.
16    A school district may employ a sufficient number of school

1nurses to address the needs of its students, but no less than a
2student-to-school nurse ratio of 750 to 1. Consideration for
3school nurse staffing should include the complex health needs
4of students, the need for continuous professional nursing
5services, the number of free and reduced-price lunch students
6in a school building, and the average number of medical
7emergencies at a school per year.

10    Sec. 14-1.09. School psychologist. "School psychologist"
11means a psychologist who meets the following qualifications:
12        (1) The psychologist:
13            (A) has graduated with a master's or higher degree
14        in psychology or educational psychology from an
15        institution of higher learning that maintains
16        equipment, courses of study, and standards of
17        scholarship approved by the State Board of Education,
18        has had at least one school year of full-time
19        supervised experience in the delivery of school
20        psychological services of a character approved by the
21        State Superintendent of Education, and has such
22        additional qualifications as may be required by the
23        State Board of Education; or
24            (B) holds a valid Nationally Certified School
25        Psychologist (NCSP) credential.

1        (2) The psychologist holds a Professional Educator
2    License with a school psychologist endorsement issued
3    pursuant to Section 21B-25 of this Code. Persons so
4    licensed may use the title "school psychologist" and may
5    offer school psychological services which are limited to
6    those services set forth in 23 Ill. Adm. Code 226, Special
7    Education, pertaining to children between the ages of 3 to
8    21, promulgated by the State Board of Education.
9    School psychologists may make evaluations, recommendations
10or interventions regarding the placement of children in
11educational programs or special education classes. However, a
12school psychologist shall not provide such services outside
13his or her employment to any student in the district or
14districts which employ such school psychologist.
15    A school district may employ a sufficient number of school
16psychologists to address the needs of the school district's
17students and schools, but no less than a student-to-school
18psychologist ratio of 500 to 1.

20    Section 99. Effective date. This Act takes effect June 30,
