3 | | on page 2, line 12, after "3,", by inserting "3.1,"; and |
4 | | on page 7, line 21, after "(l)", by inserting " remediation of |
5 | | and compensation for visual deficits, including "; and |
6 | | on page 13, immediately below line 8, by inserting the |
7 | | following:

10 | | Sec. 3.1. Referrals. |
11 | | (a) A licensed occupational therapist or licensed
|
12 | | occupational therapy assistant may evaluate, initiate, and |
13 | | provide occupational therapy services and consult with, |
14 | | educate, evaluate, and monitor
services for individuals, |

1 | | groups, and populations concerning occupational therapy needs |
2 | | without a referral . Except as indicated in subsections (b) and |
3 | | (c) of this Section, implementation
of direct occupational |
4 | | therapy treatment to individuals for their specific
health |
5 | | care conditions shall be based upon a referral from a licensed
|
6 | | physician, dentist, podiatric physician, advanced practice |
7 | | registered nurse, physician assistant, or optometrist.
|
8 | | (b) (Blank). A referral is not required for the purpose of |
9 | | providing consultation, habilitation, screening, education, |
10 | | wellness, prevention, environmental assessments, and |
11 | | work-related ergonomic services to individuals, groups, or |
12 | | populations. |
13 | | (c) Referral from a physician or other health care |
14 | | provider is not required for evaluation or intervention for |
15 | | children and youths if an occupational therapist or |
16 | | occupational therapy assistant provides services in a |
17 | | school-based or educational environment, including the child's |
18 | | home. |
19 | | (d) An occupational therapist shall refer to a licensed |
20 | | physician, dentist,
optometrist, advanced practice registered |
21 | | nurse, physician assistant, or podiatric physician any a |
22 | | patient to the patient's treating health care professional of |
23 | | record, or to a health care professional of the patient's |
24 | | choosing if there is no health care professional of record, |
25 | | if: |
26 | | (1) the patient does not demonstrate measurable or |

|
1 | | functional improvement after 10 visits or 15 business |
2 | | days, whichever occurs first, and continued improvement |
3 | | thereafter; |
4 | | (2) the patient was under the care of an occupational |
5 | | therapist without a diagnosis established by a health care |
6 | | professional of a chronic disease that may benefit from |
7 | | occupational therapy and returns for services for the same |
8 | | or similar condition 30 calendar days after being |
9 | | discharged by the occupational therapist; or |
10 | | (3) the patient's whose medical condition should , at |
11 | | the
time of evaluation or services treatment , is be |
12 | | determined to be beyond the scope of
practice of the |
13 | | occupational therapist.

2 | | assistant in accordance with Section 3.1, dentist, |
3 | | podiatric physician, or optometrist, or having failed to |
4 | | notify the physician, advanced practice registered nurse, |
5 | | physician assistant, dentist, podiatric physician, or |
6 | | optometrist who established a diagnosis that the patient |
7 | | is receiving occupational therapy pursuant to that |
8 | | diagnosis ;".
