SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Enhanced Oil Recovery Ban Act. Provides that a person shall not inject a concentrated carbon dioxide fluid produced by a carbon dioxide capture project or carbon dioxide capture and sequestration project into a Class II well for purposes of enhanced oil recovery, including the facilitation of enhanced oil recovery from another well. Provides that an individual who violates the Act is subject to a fine of $20,000 for each violation. Defines terms. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Enhanced Oil Recovery Ban Act.
 
6    Section 5. Intent. The General Assembly finds and declares
7that the purpose of carbon-capture technologies and carbon
8capture and sequestration is to facilitate the transition to a
9carbon-neutral society and not to facilitate continued
10dependence upon fossil fuel production.
 
11    Section 10. Definitions. In this Act:
12    "Carbon dioxide capture project" means a project that uses
13a process to separate carbon dioxide from industrial or
14energy-related sources, other than oil or gas production from
15a well, and produces a concentrated fluid of carbon dioxide
16with the intent of preventing emission of the carbon dioxide
17into the atmosphere.
18    "Carbon dioxide capture and sequestration project" means a
19carbon dioxide capture project that seeks to provide for the
20long-term isolation of the concentrated carbon dioxide fluid
21from the atmosphere through storage in a geologic formation.
22    "Class II well" has the same meaning as in 40 CFR 144.6.

1    "Concentrated carbon dioxide fluid" means a fluid that
2contains concentrated carbon dioxide that is proportionately
3greater than the ambient atmospheric concentration of carbon
4dioxide.
 
5    Section 15. Enhanced oil recovery ban.
6    (a) A person shall not inject a concentrated carbon
7dioxide fluid produced by a carbon dioxide capture project or
8carbon dioxide capture and sequestration project into a Class
9II well for purposes of enhanced oil recovery, including the
10facilitation of enhanced oil recovery from another well.
11    (b) An individual who violates this Act is subject to a
12fine of $20,000 for each violation.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
