SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/19-3  from Ch. 38, par. 19-3

    Amends the Criminal Code of 2012. Provides that a person commits residential burglary when he or she knowingly and without authority enters on the property of another, or any part thereof, with the intent to commit therein a theft of a motor vehicle. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by
5changing Section 19-3 as follows:
 
6    (720 ILCS 5/19-3)  (from Ch. 38, par. 19-3)
7    Sec. 19-3. Residential burglary.
8    (a) A person commits residential burglary when he or she
9knowingly and without authority enters or knowingly and
10without authority remains within the dwelling place of
11another, or any part thereof, with the intent to commit
12therein a felony or theft. This offense includes the offense
13of burglary as defined in Section 19-1.
14    (a-5) A person commits residential burglary when he or she
15falsely represents himself or herself, including but not
16limited to falsely representing himself or herself to be a
17representative of any unit of government or a construction,
18telecommunications, or utility company, for the purpose of
19gaining entry to the dwelling place of another, with the
20intent to commit therein a felony or theft or to facilitate the
21commission therein of a felony or theft by another.
22    (a-10) A person commits residential burglary when he or
23she knowingly and without authority enters on the property of

1another, or any part thereof, with the intent to commit
2therein a theft of a motor vehicle.
3    (b) Sentence. Residential burglary is a Class 1 felony.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.
