2 | | AMENDMENT NO. ______. Amend Senate Bill 1772, AS AMENDED, |
3 | | by replacing everything after the enacting clause with the |
4 | | following:

5 | | "Section 1. Short title. This Act may be cited as the |
6 | | Pesticide Application at Schools Act. |
7 | | Section 5. Legislative findings. The General Assembly |
8 | | finds that: |
9 | | (1) schools throughout the State treat school property |
10 | | with pesticides in order to reduce risks to students from |
11 | | noxious weeds, such as thistle, poison ivy, pests, |
12 | | allergies, disease bearing insects, and activities on |
13 | | unlevel playing surfaces; |
14 | | (2) unless properly applied in accordance with the |
15 | | United States Environmental Protection Agency's pesticide |
16 | | labels, schools may inadvertently expose children to |

1 | | pesticides; and |
2 | | (3) it is the purpose of this Act to minimize student |
3 | | exposure to pesticides. |
4 | | Section 10. Definition. As used in this Act, "school day" |
5 | | has the same meaning given to that term in Section 300.11 of |
6 | | the federal Individuals with Disabilities Education Act. |
7 | | Section 15. Pesticide application prohibited. Beginning |
8 | | July 1, 2024, a school serving students grades kindergarten |
9 | | through 8th grade is prohibited from scheduling pesticide |
10 | | applications on school grounds during the school day, |
11 | | including during a partial day, when students are in |
12 | | attendance at school for instructional purposes. Areas |
13 | | prohibited from treatment include paved surfaces, playgrounds, |
14 | | and playing fields. This Section shall not apply to areas of |
15 | | school grounds where children are not typically present, |
16 | | including, but not limited to, flower beds and lawns |
17 | | surrounding the school not used as playing fields.

18 | | Section 99. Effective date. This Act takes effect upon |
19 | | becoming law.".
