Amends the Illinois Pesticide Act. Provides that no person, other than a pesticide applicator under the direct supervision of a supervisory pesticide applicator, may apply a pesticide within any school building or on the grounds of any school. Exempts emergency application of a pesticide meeting specified requirements from the provisions.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pesticide Act is amended by adding |
5 | | Section 13.10 as follows: |
6 | | (415 ILCS 60/13.10 new) |
7 | | Sec. 13.10. Lawn care pesticides; schools. |
8 | | (a) In this Section: |
9 | | "Biochemical pesticide" means a naturally occurring |
10 | | substance that controls pests by nontoxic mechanisms. |
11 | | "Integrated pest management" has the same meaning as |
12 | | defined in Section 3.25 of the Structural Pest Control Act. |
13 | | "Integrated pest management plan" means a written plan for |
14 | | integrated pest management. |
15 | | "Lawn care pesticide" means a pesticide registered by the |
16 | | United States Environmental Protection Agency and labeled |
17 | | pursuant to the federal Insecticide, Fungicide and Rodenticide |
18 | | Act for use in lawn, garden, or ornamental sites or areas. |
19 | | "Lawn care pesticide" does not include: |
20 | | (1) a microbial pesticide or biochemical pesticide |
21 | | that is registered with the United States Environmental |
22 | | Protection Agency; |
23 | | (2) a horticultural soap or oil that is registered |
