2 | | AMENDMENT NO. ______. Amend Senate Bill 1699 as follows:

3 | | on page 1, line 5, by replacing "Section" with "Sections 8.7 |
4 | | and"; and |
5 | | on page 1, immediately below line 5, by inserting the |
6 | | following: |
7 | | "(225 ILCS 90/8.7 new) |
8 | | Sec. 8.7. Criminal history records background check. Each |
9 | | applicant for licensure under Sections 8, 8.1, and 11 shall |
10 | | have his or her fingerprints submitted to the Illinois State |
11 | | Police in an electronic format that complies with the form and |
12 | | manner for requesting and furnishing criminal history record |
13 | | information as prescribed by the Illinois State Police. These |
14 | | fingerprints shall be checked against the Illinois State |
15 | | Police and Federal Bureau of Investigation criminal history |

1 | | record databases now and hereafter filed. The Illinois State |
2 | | Police shall charge applicants a fee for conducting the |
3 | | criminal history records check, which shall be deposited into |
4 | | the State Police Services Fund and shall not exceed the actual |
5 | | cost of the records check. The Illinois State Police shall |
6 | | furnish, pursuant to positive identification, records of |
7 | | Illinois convictions to the Department. The Department may |
8 | | require applicants to pay a separate fingerprinting fee, |
9 | | either to the Department or to a vendor designated or approved |
10 | | by the Department. The Department, in its discretion, may |
11 | | allow an applicant or licensee who does not have reasonable |
12 | | access to a designated vendor to provide his or her |
13 | | fingerprints in an alternative manner. Communication between |
14 | | the Department and an interstate compact governing body or |
15 | | other entities may not include information received from the |
16 | | Federal Bureau of Investigation relating to a State and |
17 | | federal criminal history records check. The Department may |
18 | | adopt any rules necessary to implement this Section. ".
