Amends the Rivers, Lakes and Streams Act. Provides that the Department of Natural Resources shall collect a fee of up to $5,000 annually per Lake Michigan water allocation permit issued under the Act. Provides that fees collected under the Act shall be deposited into the State Boating Act Fund for use by the Department for water allocation monitoring and water supply planning.

1 | | AN ACT concerning transportation.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Rivers, Lakes, and Streams Act is amended |
5 | | by changing Section 35 as follows: |
6 | | (615 ILCS 5/35) |
7 | | Sec. 35. Permit fees. The Department of Natural Resources |
8 | | shall collect a fee of up to $5,000 per application for permits |
9 | | and annually per Lake Michigan water allocation permit issued |
10 | | under this Act. The Department of Natural Resources shall set |
11 | | the specific fee applicable to different permits and water |
12 | | allocation permits issued under this Act by administrative |
13 | | rule, provided that no fee exceeds $5,000. All fees collected |
14 | | pursuant to this Section shall be deposited in the State |
15 | | Boating Act Fund for use by the Department of Natural |
16 | | Resources for water allocation monitoring, water supply |
17 | | planning, and the ordinary and contingent expenses of the |
18 | | Department of Natural Resources. No permit application shall |
19 | | be processed until the application fee is paid to the |
20 | | Department of Natural Resources. The monies deposited into the |
21 | | State Boating Act Fund under this Section shall not be subject |
22 | | to administrative charges or chargebacks unless otherwise |
23 | | authorized by this Act.
