2 | | AMENDMENT NO. ______. Amend Senate Bill 1352 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The School Code is amended by changing Section |
5 | | 24-14 as follows:
|
6 | | (105 ILCS 5/24-14) (from Ch. 122, par. 24-14)
|
7 | | Sec. 24-14. Termination of contractual continued service |
8 | | by teacher. As used in this Section, "teaching assignment" |
9 | | means any full-time position that requires licensure under |
10 | | Article 21B of this Code. |
11 | | A teacher, as defined in Section 24-11 of this Code, who
|
12 | | has entered into contractual continued service may resign
at |
13 | | any time by obtaining concurrence of the board or by serving at |
14 | | least 30
days' written notice upon the secretary of the board . |
15 | | During the school term, However, no teacher
may resign during |
16 | | the school term , without the concurrence of the board,

1 | | order to accept another teaching assignment. Outside of a |
2 | | school term, a resignation submitted by any teacher after the |
3 | | completion of the school year must be submitted in writing to |
4 | | the secretary of the board a minimum of 30 calendar days prior |
5 | | to the first student attendance day of the following school |
6 | | year or else the teacher will be deemed to have resigned during |
7 | | the school term. Any teacher
terminating said service not in |
8 | | accordance with this Section may be referred by the board to |
9 | | the State Superintendent of Education. A referral to the State |
10 | | Superintendent for an alleged violation of this Section must |
11 | | include (i) a dated copy of the teacher's resignation letter, |
12 | | (ii) a copy of the reporting district's current school year |
13 | | calendar, (iii) proof of employment for the school year at |
14 | | issue, (iv) documentation showing that the district's board |
15 | | did not accept the teacher's resignation, and (v) evidence |
16 | | that the teacher left the district in order to accept another |
17 | | teaching assignment. If the district intends to submit a |
18 | | referral to the State Superintendent, the district shall |
19 | | submit the referral to the State Superintendent within 10 |
20 | | business days after the board denies acceptance of the |
21 | | resignation. The district shall notify the teacher that it |
22 | | submitted the referral to the State Superintendent within 5 |
23 | | business days after submitting the referral to the State |
24 | | Superintendent. The State Superintendent or his or her |
25 | | designee shall convene an informal evidentiary hearing no |
26 | | later than 90 days after receipt of the required documentation |

1 | | from the school district as required in this Section of a |
2 | | resolution by the board . The teacher shall receive a written |
3 | | determination from the State Superintendent or his or her |
4 | | designee no later than 14 days after the hearing is completed. |
5 | | If the State Superintendent or his or her designee finds that |
6 | | the teacher resigned during the school term without the |
7 | | concurrence of the board to accept another teaching |
8 | | assignment, the State Superintendent must suspend the |
9 | | teacher's license for one calendar year. In lieu of a hearing |
10 | | and finding, the teacher may agree to a lesser licensure |
11 | | sanction at the discretion of the State Superintendent or his |
12 | | or her designee .
