2 | | AMENDMENT NO. ______. Amend Senate Bill 692 by replacing |
3 | | everything after the enacting clause with the following: |
4 | | "Section 5. The Department of Commerce and Economic |
5 | | Opportunity Law of the Civil Administrative Code of Illinois |
6 | | is amended by adding Section 605-1115 as follows: |
7 | | (20 ILCS 605/605-1115 new) |
8 | | Sec. 605-1115. Task Force on Interjurisdictional |
9 | | Industrial Zoning Impacts. |
10 | | (a) The General Assembly finds that industrial |
11 | | developments typically have regional impacts, both positive |
12 | | and negative. Those impacts extend beyond the zoning authority |
13 | | of the unit of local government where the development is |
14 | | located. Units of local government may experience impacts on |
15 | | public health, public safety, the environment, traffic, |
16 | | property values, population, and other considerations as a |

1 | | result of industrial development occurring outside of the |
2 | | their zoning jurisdiction, including areas adjacent to their |
3 | | borders. |
4 | | (b) The Task Force on Interjurisdictional Industrial |
5 | | Zoning Impacts is created within the Department of Commerce |
6 | | and Economic Opportunity. The Task Force shall examine the |
7 | | following: |
8 | | (1) current State and local zoning laws and policies |
9 | | related to large industrial developments; |
10 | | (2) current State and local laws and policies related |
11 | | to annexation; |
12 | | (3) State and local zoning and annexation laws and |
13 | | policies outside of Illinois; |
14 | | (4) the potential impacts of large industrial |
15 | | developments on neighboring units of local government, |
16 | | including how those developments may affect residential |
17 | | communities; |
18 | | (5) trends in industrial zoning across urban, |
19 | | suburban, and rural regions of Illinois; |
20 | | (6) available methodologies to determine the impact of |
21 | | large industrial developments; and |
22 | | (7) outcomes in recent zoning proceedings for large |
23 | | industrial developments or attempts to develop properties |
24 | | for large industrial purposes, including the recent |
25 | | attempt to convert a 101 acre campus in Lake County near |
26 | | Deerfield. |

1 | | (c) The Task Force on Interjurisdictional Industrial |
2 | | Zoning Impacts shall consist of the following members: |
3 | | (1) the Director of Commerce and Economic Opportunity |
4 | | or his or her designee; |
5 | | (2) one member, appointed by the President of the |
6 | | Senate, representing a statewide organization of |
7 | | municipalities described in Section 1-8-1 of the Illinois |
8 | | Municipal Code; |
9 | | (3) one member, appointed by the President of the |
10 | | Senate, representing a regional association of |
11 | | municipalities and mayors; |
12 | | (4) one member, appointed by the Speaker of the House |
13 | | of Representatives, representing a statewide association |
14 | | representing counties; |
15 | | (5) one member, appointed by the Speaker of the House |
16 | | of Representatives, representing a regional association of |
17 | | municipalities and mayors; |
18 | | (6) one member, appointed by the Minority Leader of |
19 | | the Senate, representing a statewide professional economic |
20 | | development association; |
21 | | (7) one member, appointed by the Minority Leader of |
22 | | the House of Representatives, representing a statewide |
23 | | association of park districts; |
24 | | (8) one member representing the Office of the |
25 | | Governor, appointed by the Governor; |
26 | | (9) one member of the Senate, appointed by the |

1 | | President of the Senate; |
2 | | (10) one member of the Senate, appointed by the |
3 | | Minority Leader of the Senate; |
4 | | (11) one member of the House of Representatives, |
5 | | appointed by the Speaker of the House of Representatives; |
6 | | and |
7 | | (12) one member of the House of Representatives, |
8 | | appointed by the Minority Leader of the House of |
9 | | Representatives. |
10 | | (d) The members of the Task Force shall serve without |
11 | | compensation. The Department of Commerce and Economic |
12 | | Opportunity shall provide administrative support to the Task |
13 | | Force. |
14 | | (e) The Task Force shall meet at least once every 2 months. |
15 | | Upon the first meeting of the Task Force, the members of the |
16 | | Task Force shall elect a chairperson of the Task Force. |
17 | | (f) The Task Force shall prepare a report on its findings |
18 | | concerning zoning for large industrial development and |
19 | | associated interjurisdictional impacts, including any |
20 | | recommendations. The report shall be submitted to the Governor |
21 | | and the General Assembly no later than December 31, 2025. |
22 | | (g) This Section is repealed June 1, 2026. |
23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.". |
