SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code. Changes a reference to "traffic-control signal" to "traffic control signal". Removes a reference to a "motorman of a streetcar". Provides that a driver approaching a stop intersection indicated by a stop sign shall stop before entering the crosswalk on the near side of the intersection.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Sections 11-904 and 11-1204 as follows:
 
6    (625 ILCS 5/11-904)  (from Ch. 95 1/2, par. 11-904)
7    Sec. 11-904. Vehicle entering stop or yield intersection.
8    (a) Preferential right-of-way at an intersection may be
9indicated by stop or yield signs as authorized in Section
1011-302 of this Chapter.
11    (b) Except when directed to proceed by a police officer or
12traffic control traffic-control signal, every driver of a
13vehicle approaching a stop intersection indicated by a stop
14sign shall stop at a clearly marked stop line, but if none,
15before entering the crosswalk on the near side of the
16intersection, or if none, then at the point nearest the
17intersecting roadway where the driver has a view of
18approaching traffic on the intersecting roadway before
19entering the intersection. After having stopped, the driver
20shall yield the right-of-way to any vehicle which has entered
21the intersection from another roadway or which is approaching
22so closely on the roadway as to constitute an immediate hazard
23during the time when the driver is moving across or within the

1intersection, but said driver having so yielded may proceed at
2such time as a safe interval occurs.
3    (c) The driver of a vehicle approaching a yield sign shall
4in obedience to such sign slow down to a speed reasonable for
5the existing conditions and, if required for safety to stop,
6shall stop at a clearly marked stop line, but if none, before
7entering the crosswalk on the near side of the intersection,
8or if none, then at the point nearest the intersecting roadway
9where the driver has a view of approaching traffic on the
10intersecting roadway. After slowing or stopping, the driver
11shall yield the right-of-way to any vehicle in the
12intersection or approaching on another roadway so closely as
13to constitute an immediate hazard during the time such driver
14is moving across or within the intersection.
15    (d) If a driver is involved in a collision at an
16intersection or interferes with the movement of other vehicles
17after driving past a yield right-of-way sign, such collision
18or interference shall be deemed prima facie evidence of the
19driver's failure to yield right-of-way.

23    (a) Preferential right-of-way at an intersection may be
24indicated by stop signs or yield signs as authorized in
25Section 11-302 of this Act.

12    (c) The driver of a vehicle approaching a yield sign if
13required for safety to stop shall stop before entering the
14crosswalk on the near side of the intersection or, in the event
15there is no crosswalk, at a clearly marked stop line, but if
16none, then at the point nearest the intersecting roadway where
17the driver has a view of approaching traffic on the
18intersecting roadway.
