HOUSE RESOLUTION

 
2    WHEREAS, The Rights of Crime Victims and Witnesses Act
3guarantees to crime victims the rights assured by Article I,
4Section 8.1 of the Illinois Constitution to ensure that crime
5victims are treated with fairness and respect for their
6dignity and privacy throughout the criminal justice system, to
7ensure that crime victims are informed of their rights and
8have standing to assert their rights in the trial and
9appellate courts, to establish procedures for enforcement of
10those rights, and to increase the effectiveness of the
11criminal justice system by affording certain basic rights and
12considerations to the witnesses of crime who are essential to
13prosecution; and
 
14    WHEREAS, The Rights of Crime Victims and Witnesses Act
15guarantees to all crime victims timely notification of all
16court proceedings; and
 
17    WHEREAS, The retail loss prevention report and notice
18requirements created by Public Act 103-757, the Illinois
19Integrity, Notification, and Fairness in Online Retail
20Marketplaces for Consumers Act, granted non-human victims
21greater rights than human victims, including the right to
22seven days' notice of any court proceedings; and

1    WHEREAS, State's attorneys and victim advocates work
2diligently, sometimes with insufficient resources, to
3accomplish the difficult task of effectuating communication
4with all victims as soon as possible; and
 
5    WHEREAS, The judiciary works diligently to dispose of all
6cases in a timely manner; and
 
7    WHEREAS, Cuts to federal Victim of Crime Act funding and
8requirements created by the SAFE-T Act have placed additional
9pressures on the judiciary, law enforcement, state's
10attorneys, and victim advocates; and
 
11    WHEREAS, It is impracticable to impose a daily timeframe
12upon state's attorneys to complete notice in every case;
13therefore, be it
 
14    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
15HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
16we recognize that human victims deserve equal rights to
17non-human victims regarding the timely notice of proceedings;
18and be it further
 
19    RESOLVED, That we urge members of the judiciary and law
20enforcement to prioritize human victims within daily court
21dockets over corporate/business entities; and be it further

2delivered to all suitable members of the judiciary.
