2 | WHEREAS, The Rights of Crime Victims and Witnesses Act | ||||||
3 | guarantees to crime victims the rights assured by Article I, | ||||||
4 | Section 8.1 of the Illinois Constitution to ensure that crime | ||||||
5 | victims are treated with fairness and respect for their | ||||||
6 | dignity and privacy throughout the criminal justice system, to | ||||||
7 | ensure that crime victims are informed of their rights and | ||||||
8 | have standing to assert their rights in the trial and | ||||||
9 | appellate courts, to establish procedures for enforcement of | ||||||
10 | those rights, and to increase the effectiveness of the | ||||||
11 | criminal justice system by affording certain basic rights and | ||||||
12 | considerations to the witnesses of crime who are essential to | ||||||
13 | prosecution; and
| ||||||
14 | WHEREAS, The Rights of Crime Victims and Witnesses Act | ||||||
15 | guarantees to all crime victims timely notification of all | ||||||
16 | court proceedings; and | ||||||
17 | WHEREAS, The retail loss prevention report and notice | ||||||
18 | requirements created by Public Act 103-757, the Illinois | ||||||
19 | Integrity, Notification, and Fairness in Online Retail | ||||||
20 | Marketplaces for Consumers Act, granted non-human victims | ||||||
21 | greater rights than human victims, including the right to | ||||||
22 | seven days' notice of any court proceedings; and

1 | WHEREAS, State's attorneys and victim advocates work | ||||||
2 | diligently, sometimes with insufficient resources, to | ||||||
3 | accomplish the difficult task of effectuating communication | ||||||
4 | with all victims as soon as possible; and
| ||||||
5 | WHEREAS, The judiciary works diligently to dispose of all | ||||||
6 | cases in a timely manner; and
| ||||||
7 | WHEREAS, Cuts to federal Victim of Crime Act funding and | ||||||
8 | requirements created by the SAFE-T Act have placed additional | ||||||
9 | pressures on the judiciary, law enforcement, state's | ||||||
10 | attorneys, and victim advocates; and
| ||||||
11 | WHEREAS, It is impracticable to impose a daily timeframe | ||||||
12 | upon state's attorneys to complete notice in every case; | ||||||
13 | therefore, be it
| ||||||
14 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
15 | HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
16 | we recognize that human victims deserve equal rights to | ||||||
17 | non-human victims regarding the timely notice of proceedings; | ||||||
18 | and be it further | ||||||
19 | RESOLVED, That we urge members of the judiciary and law | ||||||
20 | enforcement to prioritize human victims within daily court | ||||||
21 | dockets over corporate/business entities; and be it further
