SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Toll Highway Oasis Reinvestment Act. Provides that if an oasis has been operational for more than 5 years within the jurisdiction and boundaries of a local government and has been subsequently removed due to toll highway expansion, the Authority shall offer any adjacent land previously associated with the oasis to the respective local government for the purpose of developing a new travel oasis. Requires the terms of the land transfer to the local government to be under a lease agreement for a term of 50 years, with 2 successive renewal options of 25 years each. Requires the local government to pay the Authority a fee equivalent to 5% of the gross revenue generated from the redeveloped oasis throughout the duration of the lease and its renewals. Requires the local government, upon accepting the terms of the land transfer, to enter into a project labor agreement for the construction, renovation, or any development work pertaining to the oasis. Provides that project labor agreement shall ensure that all labor used for the project adheres to local labor standards and regulations. Grants rulemaking authority. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Toll
5Highway Oasis Reinvestment Act.
 
6    Section 5. Definitions. In this Act:
7    "Authority" means the Illinois State Toll Highway
8Authority.
9    "Local government" means the municipality in which an
10oasis is located or, if the oasis is not located within a
11municipality, the county in which the oasis is located.
12    "Oasis" means any over-the-highway facility that provides
13food, fuel, and other services to travelers on the toll
14highway system.
 
15    Section 10. Land transfer for oasis development.
16    (a) If an oasis has been operational for more than 5 years
17within the jurisdiction and boundaries of a local government
18and has been subsequently removed due to toll highway
19expansion, the Authority shall offer any adjacent land
20previously associated with the oasis to the respective local
21government for the purpose of developing a new oasis.
22    (b) The terms of the land transfer to the local government

1shall be under a lease agreement for a term of 50 years, with 2

3    (c) The local government shall pay the Authority a fee
4equivalent to 5% of the gross revenue generated from the

7    Section 15. Project labor agreement requirement. The local
8government, upon accepting the terms of the land transfer,
9shall enter into a project labor agreement for the
10construction, renovation, or any development work pertaining
11to the oasis. The project labor agreement shall ensure that
12all labor used for the project adheres to local labor
13standards and regulations.
 
14    Section 20. Implementation and oversight. The Authority
15shall implement any additional rules and regulations necessary
16to administer the provisions of this Act.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
