    Amends various Acts relating to the governance of public universities in Illinois. Makes changes to the provisions concerning the in-state tuition charge to require that, for tuition purposes beginning with the 2025-2026 academic year, the governing board of each public university, at a minimum, deem an individual, other than an excluded nonimmigrant alien, an Illinois resident, until the individual establishes a residence outside of this State, if the individual (1) attended a specified institution located in this State; (2) graduated from a high school or received the equivalent of a high school diploma in this State, attained an associate degree from a public community college, or completed a General Education Core Curriculum package under the Illinois Articulation Initiative Act for students transferring from a public community college; (3) is a current student of or is registering as an entering student in the university; and (4) attests, if the individual is not a citizen or a lawful permanent resident of the United States, that the individual will file an application to become a permanent resident of the United States at the earliest opportunity.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 as follows:
 
6    (110 ILCS 305/7e-5)
7    Sec. 7e-5. In-state tuition charge.
8    (a) Notwithstanding any other provision of law to the
9contrary, for tuition purposes through the 2024-2025 academic
10year, the Board of Trustees shall deem an individual an
11Illinois resident, until the individual establishes a
12residence outside of this State, if all of the following
13conditions are met:
14        (1) The individual resided with his or her parent or
15    guardian while attending a public or private high school
16    in this State.
17        (2) The individual graduated from a public or private
18    high school or received the equivalent of a high school
19    diploma in this State.
20        (3) The individual attended school in this State for
21    at least 3 years as of the date the individual graduated
22    from high school or received the equivalent of a high
23    school diploma.

1        (4) The individual registers as an entering student in
2    the University not earlier than the 2003 fall semester.
3        (5) In the case of an individual who is not a citizen
4    or a permanent resident of the United States, the
5    individual provides the University with an affidavit
6    stating that the individual will file an application to
7    become a permanent resident of the United States at the
8    earliest opportunity the individual is eligible to do so.
9    This subsection (a) applies only to tuition for a term or
10semester that begins on or after May 20, 2003 (the effective
11date of Public Act 93-7) but before the 2025-2026 academic
12year. Any revenue lost by the University in implementing this
13subsection (a) shall be absorbed by the University Income
14Fund.
15    (a-5) As used in this subsection (a-5), "excluded
16nonimmigrant alien" means an alien identified in 8 U.S.C.
171101(a)(15)(F), 8 U.S.C. 1101(a)(15)(J), or 8 U.S.C.
181101(a)(15)(M).
19    Notwithstanding any other provision of law to the
20contrary, for tuition purposes beginning with the 2025-2026
21academic year, the Board of Trustees shall, at a minimum, deem
22an individual, other than an excluded nonimmigrant alien, an
23Illinois resident, until the individual establishes a
24residence outside of this State, if all of the following
25conditions are met:
26        (1) The individual attended, on campus, and attained

1    credits at any of the following institutions in this
2    State:
3            (A) A public or nonpublic elementary school.
4            (B) A public or nonpublic high school.
5            (C) An adult education program funded by the
6        Illinois Community College Board under the Public
7        Community College Act.
8            (D) A community college organized under the Public
9        Community College Act.
10        (2) The individual satisfies any of the following:
11            (A) The individual graduated from a public or
12        nonpublic high school or received the equivalent of a
13        high school diploma in this State.
14            (B) The individual attained an associate degree
15        from a community college organized under the Public
16        Community College Act.
17            (C) The individual completed a General Education
18        Core Curriculum package under the Illinois
19        Articulation Initiative Act for students transferring
20        from a community college organized under the Public
21        Community College Act.
22        (3) The individual is a current student of or is
23    registering as an entering student in the University.
24        (4) The individual attests, if the individual is not a
25    citizen or a lawful permanent resident of the United

6    (b) If a person is on active military duty and stationed in
7Illinois, then the Board of Trustees shall deem that person
8and any of his or her dependents Illinois residents for
9tuition purposes. Beginning with the 2009-2010 academic year,
10if a person is on active military duty and is stationed out of
11State, but he or she was stationed in this State for at least 3
12years immediately prior to being reassigned out of State, then
13the Board of Trustees shall deem that person and any of his or
14her dependents Illinois residents for tuition purposes, as
15long as that person or his or her dependent (i) applies for
16admission to the University within 18 months of the person on
17active military duty being reassigned or (ii) remains
18continuously enrolled at the University. Beginning with the
192013-2014 academic year, if a person is utilizing benefits
20under the federal Post-9/11 Veterans Educational Assistance
21Act of 2008 or any subsequent variation of that Act, then the
22Board of Trustees shall deem that person an Illinois resident
23for tuition purposes. Beginning with the 2015-2016 academic
24year, if a person is utilizing benefits under the federal
25All-Volunteer Force Educational Assistance Program, then the
26Board of Trustees shall deem that person an Illinois resident

1for tuition purposes. Beginning with the 2019-2020 academic
2year, per the federal requirements for maintaining approval
3for veterans' education benefits under 38 U.S.C. 3679(c), if a
4person is on active military duty or is receiving veterans'
5education benefits, then the Board of Trustees shall deem that
6person an Illinois resident for tuition purposes for any
7academic quarter, semester, or term, as applicable.

9    Section 10. The Southern Illinois University Management
10Act is amended by changing Section 8d-5 as follows:
