AMENDMENT TO HOUSE BILL 5397

2    AMENDMENT NO. ______. Amend House Bill 5397 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Petroleum Education and Marketing
5Act is amended by changing Section 10 as follows:
 
6    (225 ILCS 728/10)
7    (Section scheduled to be repealed on January 1, 2028)
8    Sec. 10. Illinois Petroleum Resources Board.
9    (a) There is hereby created the Illinois Petroleum
10Resources Board, which shall be subject to the provisions of
11the Regulatory Sunset Act. The purpose of the Board is to
12coordinate a program designed to demonstrate to the general
13public the importance of the Illinois oil and gas exploration
14and production industry, to encourage the wise and efficient
15use of energy, to promote environmentally sound production
16methods and technologies, to develop existing supplies of

1State oil and gas resources, to support research and
2educational activities concerning the oil and gas exploration
3and production industry, and to support oilfield environmental
4remediation and restoration activities.
5    (b) The Board shall be composed of 12 members to be
6appointed as follows:
7        (1) Through December 31, 2006, the Governor shall make
8    appointments from a list of names submitted by qualified
9    producer associations, of which 10 shall be oil and gas
10    producers.
11        (2) Beginning January 1, 2007, all appointments shall
12    be made by the qualified producer associations.
13    (c) A member of the Board shall:
14        (1) be at least 25 years of age;
15        (2) be a resident of the State of Illinois; and
16        (3) have at least 5 years of active experience in the
17    oil industry.
18    (d) Members shall serve for a term of 3 years, except that
19of the initial appointments, 4 members shall serve for one
20year, 4 members for 2 years, and 4 members for 3 years.
21Beginning July 1, 2024, no member shall be appointed to a term
22that would cause the member to exceed 9 years of total service
23on the Board, unless approved by a two-thirds majority vote of
24the members of the qualified producer association's executive
25committee who are present and voting.
26    (e) Vacancies shall be filled for the unexpired term of

1office in the same manner as the original appointment.
2    (f) The Board shall, at its first meeting, elect one of its
3members as chairperson, who shall preside over meetings of the
4Board and perform other duties that may be required by the
5Board. The first meeting of the Board shall be called by the
6Governor.
7    (g) No member of the Board shall receive a salary or
8reimbursement for duties performed as a member of the Board,
9except that members are eligible to receive reimbursement for
10travel expenses incurred in the performance of Board duties.
