1 AMENDMENT TO HOUSE BILL 5292

2 AMENDMENT NO. ______. Amend House Bill 5292 as follows:

3 on page 2, line 2, after "displacement", by inserting "and

4 refund; consent to share"; and

5 on page 2, line 3, by replacing "Act" with "Section"; and

6 on page 2, by replacing lines 5 through 21 with the following:

7 "(b) A public institution of higher education may reduce a

8 student's institutional financial aid as a result of the

9 awarding of private scholarships to the student in order to

10 comply with the individual or team financial aid restrictions

11 of any athletic association, conference, or other group or

12 organization with authority over intercollegiate athletics,

13 including, but not limited to, the National Collegiate

14 Athletic Association.

15 (c) If a student at a public institution of higher

1 education has been awarded private scholarships and the

2 student's total financial aid from all sources exceeds the

3 student's financial need, then the public institution of

4 higher education must refund to the entity awarding the

5 private scholarships the amount that exceeds the student's

6 financial need, but no more than the amount of the private

7 scholarships awarded.

8 (d) If a student at a public institution of higher

9 education gives written consent in the form of a signature for

10 the public institution of higher education to share the

11 student's financial aid report or bill to an entity that

12 awards private scholarships, then the public institution of

13 higher education shall send that report or bill to the entity

14 upon the entity's request.".
