SYNOPSIS AS INTRODUCED:
 
20 ILCS 605/605-1080

    Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that the Department of Commerce and Economic Opportunity shall compile and publish a disparity study by December 31, 2027 (rather than December 31, 2022) that: (1) evaluates demographic data (rather than whether there exists intentional discrimination) at the supplier or distribution level for retailers of beauty products, cosmetics, hair care supplies, and personal care products in the State of Illinois; and (2) includes recommendations for reducing or eliminating any barriers to entry for underrepresented populations (rather than to those) wishing to establish businesses at the retail level involving such products. Removes language requiring the study to evaluate the impact of the discrimination evaluated under paragraph (1) on the State. Extends the repeal of the provisions to January 1, 2029 (rather than January 1, 2024). Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Commerce and Economic
5Opportunity Law of the Civil Administrative Code of Illinois
6is amended by changing Section 605-1080 as follows:
 
7    (20 ILCS 605/605-1080)
8    (Section scheduled to be repealed on January 1, 2026)
9    Sec. 605-1080. Personal care products industry supplier
10disparity study.
11    (a) The Department shall compile and publish a disparity
12study by December 31, 2027 2022 that: (1) evaluates
13demographic data whether there exists intentional
14discrimination at the supplier or distribution level for
15retailers of beauty products, cosmetics, hair care supplies,
16and personal care products in the State of Illinois; and (2) if
17so, evaluates the impact of such discrimination on the State
18and includes recommendations for reducing or eliminating any
19barriers to entry for underrepresented populations to those
20wishing to establish businesses at the retail level involving
21such products. The Department shall forward a copy of its
22findings and recommendations to the General Assembly and
23Governor.

1    (b) The Department may compile, collect, or otherwise
2gather data necessary for the administration of this Section
3and to carry out the Department's duty relating to the
4recommendation of policy changes. The Department shall compile
5all of the data into a single report, submit the report to the
6Governor and the General Assembly, and publish the report on
7its website.
8    (c) This Section is repealed on January 1, 2029 2026.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
