SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-12001.4 new
60 ILCS 1/110-13 new
65 ILCS 5/11-13-1.3 new

    Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that a county, township, or municipality that has adopted regulations relating to the construction of new buildings must require a commercial or residential building with a skylight installed in a flat roof to include a safety screen or other barrier able to withstand, at a minimum, 500 pounds. Defines "skylight". Limits the concurrent exercise of home rule powers. Effective January 1, 2026.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-12001.4 as follows:
 
6    (55 ILCS 5/5-12001.4 new)
7    Sec. 5-12001.4. Regulation of flat roof skylights.
8    (a) As used in this Section, "skylight" means a window
9measuring 12 inches or more in its least dimension that is
10installed in a roof.
11    (b) A county that has adopted regulations relating to the
12construction of new buildings must require a commercial or
13residential building with a skylight installed in a flat roof
14to include a safety screen or other barrier able to withstand,
15at a minimum, 500 pounds.
16    (c) A home rule county may not regulate flat roof
17skylights in a manner inconsistent with this Section. This
18Section is a limitation under subsection (i) of Section 6 of
19Article VII of the Illinois Constitution on the concurrent
20exercise by home rule units of powers and functions exercised
21by the State.
 
22    Section 10. The Township Code is amended by adding Section

7    (b) A township that has adopted regulations relating to
8the construction of new buildings must require a commercial or
9residential building with a skylight installed in a flat roof
10to include a safety screen or other barrier able to withstand,
11at a minimum, 500 pounds.
 
12    Section 15. The Illinois Municipal Code is amended by
13adding Section 11-13-1.3 as follows:
 
14    (65 ILCS 5/11-13-1.3 new)
15    Sec. 11-13-1.3. Regulation of flat roof skylights.
16    (a) As used in this Section, "skylight" means a window
17measuring 12 inches or more in its least dimension that is
18installed in a roof.
19    (b) A municipality that has adopted regulations relating
20to the construction of new buildings must require a commercial
21or residential building with a skylight installed in a flat
22roof to include a safety screen or other barrier able to
23withstand, at a minimum, 500 pounds.

1    (c) A home rule municipality may not regulate flat roof
2skylights in a manner inconsistent with this Section. This
3Section is a limitation under subsection (i) of Section 6 of
4Article VII of the Illinois Constitution
 
5    Section 99. Effective date. This Act takes effect January
