AMENDMENT TO HOUSE BILL 5050

2    AMENDMENT NO. ______. Amend House Bill 5050, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Decennial Committees on Local Government
6Efficiency Act is amended by changing Section 25 and by adding
7Sections 35 and 40 as follows:
 
8    (50 ILCS 70/25)
9    Sec. 25. Report. Each committee shall summarize its work
10and findings within a written report, which shall include
11recommendations in respect to increased accountability and
12efficiency, and shall provide the report to the administrative
13office of each county board in which the governmental unit is
14located no later than March 31, 2025. Thereafter, the report
15shall be filed no later than 18 months after the formation of
16the committee. The report shall be made available to the

1public.
2    For purposes of this Section, if a governmental unit is
3located in multiple counties, the committee may, if required,
4provide the same report to the county board of each of those
5counties.

8    Sec. 35. Penalties for failure to submit a report. The
9county may impose a civil penalty of up to $1,000 by board vote
10in a public meeting against a governmental unit whose
11decennial committee failed to submit to the administrative
12office of the county board a decennial report under Section
1325. The civil penalty shall be paid to the county that imposes
14the civil penalty.
15    The States Attorney for the county that imposed the civil
16penalty may bring an action in the circuit court to enforce the
17collection of a civil penalty imposed under this Section.

19    Sec. 40. County board commission; report.
20    (a) Each county board shall create a decennial commission
21every 10 years to review the efficiency and cost reduction
22analysis reports submitted by decennial committees under this
23Act. The first county decennial commission must be formed by
24April 1, 2025.

1    (b) Each county decennial commission shall conduct
2interviews with representatives from each governmental unit to
3review the decennial committee report for the governmental
4unit and ask follow-up questions, including questions related
5to: (1) any additional information discovered after the
6efficiency and cost reduction analysis was completed by the
7committee; (2) what steps the representatives believe can be
8achieved in an effort to reduce costs; and (3) how the
9governmental unit can work with the county to increase
10efficiency.
11    (c) Each county decennial commission shall compile all
12findings into a report that also shall recommend ways to
13reduce costs, increase efficiency, and consolidate services
14and shall include the names of each governmental unit whose
15decennial committee failed to submit a decennial report
16required under Section 25. The first county decennial
17commission report must be filed with the General Assembly by
18December 31, 2025. Thereafter, the report shall be filed no
19later than 24 months after the committees were required to be
20formed under Section 10.
21    (d) After a county decennial commission has submitted the
22report required under subsection (c), the commission is
23dissolved until it is reestablished under subsection (a).
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
