SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5a.1

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to incorporate telehealth services in community-integrated living arrangements for individuals with an intellectual and developmental disability for the purpose of providing medical services. Requires the Department to pay the telehealth originating site facility fees for such telehealth services. Provides that the implementation of telehealth services shall not impede the choice of any individual receiving waiver-funded services through the Home and Community-Based Services Waiver Program for Adults with Developmental Disabilities to receive in-person health care services at any time. Provides that the use of telehealth services shall not be used for the convenience of staff at any time. Removes a provision requiring the Department to file an amendment to the Home and Community-Based Services Waiver Program for Adults with Developmental Disabilities to incorporate telehealth services for persons with intellectual and developmental disabilities. Provides that implementation of the amendatory Act is subject to appropriation and federal approval. Effective January 1, 2025.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-5a.1 as follows:
 
6    (305 ILCS 5/5-5a.1)
7    Sec. 5-5a.1. Telehealth services for individuals persons
8with intellectual and developmental disabilities. The
9Department shall incorporate telehealth services in
10community-integrated living arrangements for individuals with
11an intellectual and developmental disability for the purpose
12of providing medical services. The Department shall pay for
13telehealth originating site facility fees for telehealth
14services associated with the implementation of this Section.
15The implementation of telehealth services shall not impede the
16choice of any individual receiving waiver-funded services
17through the Home and Community-Based Services Waiver Program
18for Adults with Developmental Disabilities to receive
19in-person health care services at any time. The use of
20telehealth services shall not be used for the convenience of
21staff at any time. Implementation of this Section is subject
22to appropriation and federal approval. file an amendment to

1Adults with Developmental Disabilities authorized under
2Section 1915(c) of the Social Security Act to incorporate
3telehealth services administered by a provider of telehealth
4services that demonstrates knowledge and experience in
5providing medical and emergency services for persons with
6intellectual and developmental disabilities. The Department
7shall pay administrative fees associated with implementing
8telehealth services for all persons with intellectual and
9developmental disabilities who are receiving services under
10the Home and Community-Based Services Waiver Program for
11Adults with Developmental Disabilities.
