| 1 | | AN ACT concerning regulation.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Assisted Living and Shared Housing Act is |
| 5 | | amended by changing Section 113 as follows:
|
| 6 | | (210 ILCS 9/113) |
| 7 | | Sec. 113. Assisted Living and Shared Housing Advisory |
| 8 | | Board. |
| 9 | | (a) The Governor shall establish an Assisted Living and |
| 10 | | Shared Housing Advisory Board. The Advisory Board shall |
| 11 | | consist of the following members: |
| 12 | | (1) the Director, who shall serve as chair and as an ex |
| 13 | | officio, nonvoting member; |
| 14 | | (2) the Director of Aging, who shall serve as |
| 15 | | vice-chair and as an ex officio, nonvoting member; |
| 16 | | (3) the following nonvoting members, appointed by the |
| 17 | | Director: |
| 18 | | (A) one representative of the Department; and |
| 19 | | (B) one representative of the Department on Aging, |
| 20 | | appointed in consultation with the Director of Aging; |
| 21 | | (4) the following voting members, appointed by the |
| 22 | | Director: |
| 23 | | (A) 6 members selected from candidates recommended |

| 1 | | by an organization of providers whose membership |
| 2 | | consists of assisted living establishments; |
| 3 | | (B) 3 members, one of whom must be a resident of an |
| 4 | | assisted living or shared housing establishment, |
| 5 | | selected appointed by the Director from candidates |
| 6 | | recommended by a consumer organizations organization |
| 7 | | that engage engages solely in advocacy or legal |
| 8 | | representation on behalf of senior citizens; |
| 9 | | (C) a physician; |
| 10 | | (D) a registered professional nurse; and |
| 11 | | (E) 2 members with expertise in the area of |
| 12 | | gerontology research or legal research regarding |
| 13 | | implementation of laws applying to assisted living |
| 14 | | establishments. |
| 15 | | (b) Members of the Advisory Board shall serve for terms of |
| 16 | | 3 years or until the member's successor is appointed by the |
| 17 | | Director, but the Director shall stagger the terms of initial |
| 18 | | appointees to the Advisory Board as follows: the terms of |
| 19 | | one-third shall expire after one year; the terms of one-third |
| 20 | | shall expire after 2 years; and the terms of one-third shall |
| 21 | | expire after 3 years. All initial members shall be appointed |
| 22 | | by January 1, 2025. Any member appointed to fill a vacancy |
| 23 | | occurring before the expiration of the term for which his or |
| 24 | | her predecessor was appointed shall be appointed for the |
| 25 | | remainder of that term. The Advisory Board shall meet |
| 26 | | quarterly and at the call of the Director. The affirmative |

| 1 | | vote of 9 voting members of the Advisory Board shall be |
| 2 | | necessary for any action of the Advisory Board. Members of the |
| 3 | | Advisory Board shall receive no compensation for their |
| 4 | | services but shall be reimbursed for their actual expenses. |
| 5 | | (c) The Advisory Board shall be provided copies of any |
| 6 | | additions or changes to the Assisted Living and Shared Housing |
| 7 | | Establishment Code for review and comment prior to notice |
| 8 | | being given to the public. If the Advisory Board, having been |
| 9 | | asked for its review, fails to advise the Department within 90 |
| 10 | | days, the additions or changes shall be considered acted upon |
| 11 | | in accordance with this Section. |
