2023 and 2024 HB4184 Introduced 10/25/2023, by Rep. Dave Vella SYNOPSIS AS INTRODUCED: | | | Amends the Methamphetamine Control and Community Protection Act. Provides that any person convicted of a second or subsequent offense under the Act and any person convicted of an offense under the Act who has been previously convicted of an offense under a similar law of the United States or of another state relating to the manufacture or possession of methamphetamine (rather than just convicted of a second or subsequent offense under the Act) may be sentenced to imprisonment for a term up to twice the maximum term otherwise authorized, fined an amount up to twice that otherwise authorized, or both. |

1 | | AN ACT concerning criminal law. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Methamphetamine Control and Community |
5 | | Protection Act is amended by changing Section 100 as follows: |
6 | | (720 ILCS 646/100) |
7 | | Sec. 100. Second or subsequent offenses. |
8 | | (a) Any person convicted of a second or subsequent offense |
9 | | under this Act and any person convicted of an offense under |
10 | | this Act who has been previously convicted of an offense under |
11 | | a similar law of the United States or of another state relating |
12 | | to the manufacture or possession of methamphetamine may be |
13 | | sentenced to imprisonment for a term up to twice the maximum |
14 | | term otherwise authorized, fined an amount up to twice that |
15 | | otherwise authorized, or both. |
16 | | (b) Any penalty imposed for any violation of this Act is in |
17 | | addition to, and not in lieu of, any civil or administrative |
18 | | penalty or sanction otherwise authorized by this Act or any |
19 | | other law. |
