SYNOPSIS AS INTRODUCED:
 
20 ILCS 3975/4.5

    Amends the Illinois Workforce Innovation Board Act. Provides that, by December 31, 2024, the Illinois Workforce Innovation Board must publish a report to identify strategies to address transportation access barriers that current secondary and community college students encounter when trying to access career development experiences and apprenticeship opportunities. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Workforce Innovation Board Act is
5amended by changing Section 4.5 as follows:
 
6    (20 ILCS 3975/4.5)
7    Sec. 4.5. Duties.
8    (a) The Board must perform all the functions of a state
9workforce innovation board under the federal Workforce
10Innovation and Opportunity Act, any amendments to that Act,
11and any other applicable federal statutes. The Board must also
12perform all other functions that are not inconsistent with the
13federal Workforce Innovation and Opportunity Act or this Act
14and that are assumed by the Board under its bylaws or assigned
15to it by the Governor.
16    (b) The Board must cooperate with the General Assembly and
17make recommendations to the Governor and the General Assembly
18concerning legislation necessary to improve upon statewide and
19local workforce development systems in order to increase
20occupational skill attainment, employment, retention, or
21earnings of participants and thereby improve the quality of
22the workforce, reduce welfare dependency, and enhance the
23productivity and competitiveness of the State. The Board must

1annually submit a report to the General Assembly on the
2progress of the State in achieving state performance measures
3under the federal Workforce Innovation and Opportunity Act,
4including information on the levels of performance achieved by
5the State with respect to the core indicators of performance
6and the customer satisfaction indicator under that Act. The
7report must include any other items that the Governor may be
8required to report to the Secretary of the United States
9Department of Labor.
10    (b-5) The Board shall implement a method for measuring the
11progress of the State's workforce development system by using
12benchmarks specified in the federal Workforce Innovation and
13Opportunity Act.
14    The Board shall identify the most significant early
15indicators for each benchmark, establish a mechanism to
16collect data and track the benchmarks on an annual basis, and
17then use the results to set goals for each benchmark, to inform
18planning, and to ensure the effective use of State resources.
19    (c) Nothing in this Act shall be construed to require or
20allow the Board to assume or supersede the statutory authority
21granted to, or impose any duties or requirements on, the State
22Board of Education, the Board of Higher Education, the
23Illinois Community College Board, any State agencies created
24under the Civil Administrative Code of Illinois, or any local
25education agencies.
26    (d) No actions taken by the Illinois Human Resource

1Investment Council before the effective date of this
2amendatory Act of the 92nd General Assembly and no rights,
3powers, duties, or obligations from those actions are impaired
4solely by this amendatory Act of the 92nd General Assembly.
5All actions taken by the Illinois Human Resource Investment
6Council before the effective date of this amendatory Act of
7the 92nd General Assembly are ratified and validated.
8    (e) Upon the effective date of this amendatory Act of the
9101st General Assembly, the Board shall conduct a feasibility
10study regarding the consolidation of all workforce development
11programs funded by the federal Workforce Innovation and
12Opportunity Act and conducted by the State of Illinois into
13one solitary agency to create greater access to job training
14for underserved populations. The Board shall utilize resources
15currently made available to them, including, but not limited
16to, partnering with institutions of higher education and those
17agencies currently charged with overseeing or administering
18workforce programs. The feasibility study shall:
19        (1) assess the impact of consolidation on access for
20    participants, including minority persons as defined in
21    Section 2 of the Business Enterprise for Minorities,
22    Women, and Persons with Disabilities Act, persons with
23    limited English proficiency, persons with disabilities,
24    and youth, and how consolidation would increase equitable
25    access to workforce resources;
26        (2) assess the cost of consolidation and estimate any

1    long-term savings anticipated from the action;
2        (3) assess the impact of consolidation on agencies in
3    which the programs currently reside, including, but not
4    limited to, the Department of Commerce and Economic
5    Opportunity, the Department of Employment Security, the
6    Department of Human Services, the Community College Board,
7    the Board of Higher Education, the Department of
8    Corrections, the Department on Aging, the Department of
9    Veterans' Affairs, and the Department of Children and
10    Family Services;
11        (4) assess the impact of consolidation on State
12    government employees and union contracts;
13        (5) consider if the consolidation will provide avenues
14    to maximize federal funding;
15        (6) provide recommendations for the future structure
16    of workforce development programs, including a proposed
17    timeline for implementation;
18        (7) provide direction for implementation by July 1,
19    2022 with regard to recommendations that do not require
20    legislative change;
21        (8) if legislative change is necessary, include
22    legislative language for consideration by the 102nd
23    General Assembly.
24    The Board shall submit its recommendations the Governor
25and the General Assembly by May 1, 2021.
26    (f) By December 31, 2024, the Board must publish a report

3encounter when trying to access career development experiences
4and apprenticeship opportunities.

6    Section 99. Effective date. This Act takes effect upon
7becoming law.
