1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Illinois Vehicle Code is amended by adding | |||||||||||||||||||||
5 | Sections 4-110 and 4-111 as follows: | |||||||||||||||||||||
6 | (625 ILCS 5/4-110 new) | |||||||||||||||||||||
7 | Sec. 4-110. Stolen vehicle recovery hotline. In a county | |||||||||||||||||||||
8 | having a population of 3,000,000 or more, the county sheriff | |||||||||||||||||||||
9 | shall establish with other law enforcement agencies a vehicle | |||||||||||||||||||||
10 | theft hotline to facilitate the location of stolen vehicles | |||||||||||||||||||||
11 | via their installed existing global positioning systems. The | |||||||||||||||||||||
12 | county sheriff shall collaborate with vehicle manufacturers | |||||||||||||||||||||
13 | and dealers to provide information and assistance to law | |||||||||||||||||||||
14 | enforcement officers in the investigation of vehicle theft and | |||||||||||||||||||||
15 | ensure that consumers are provided with information concerning | |||||||||||||||||||||
16 | the hotline and any new or used vehicle manufactured with a | |||||||||||||||||||||
17 | global positioning system by publishing the information in a | |||||||||||||||||||||
18 | conspicuous location on the county sheriff's website. | |||||||||||||||||||||

20 | Sec. 4-111. Manufacturer's vehicle incident hotline; law | |||||||||||||||||||||
21 | enforcement verification; manufacturer statements. | |||||||||||||||||||||
22 | (a) A manufacturer of any vehicle sold in this State shall |

1 | establish a hotline that is staffed 24 hours a day, 7 days a | ||||||
2 | week available to State, county, and local law enforcement | ||||||
3 | agencies and their respective 9-1-1 system call centers or | ||||||
4 | designated dispatch centers exclusively for the purposes of | ||||||
5 | law enforcement information sharing and the electronic | ||||||
6 | tracking of vehicles stolen in vehicular hijacking incidents | ||||||
7 | or that have been used in the commission of kidnapping, | ||||||
8 | aggravated battery with a firearm, attempted homicide, or | ||||||
9 | homicide. The manufacturer's hotline shall relay vehicle | ||||||
10 | location information, including real-time vehicle location | ||||||
11 | information whenever possible, to the 9-1-1 call center or | ||||||
12 | designated dispatch center for the responding agency, to the | ||||||
13 | best of the manufacturer's technical capability. | ||||||
14 | (b) State, county, and local law enforcement agencies | ||||||
15 | shall use their respective 9-1-1 system call centers or | ||||||
16 | designated dispatch centers for the purpose of verification of | ||||||
17 | law enforcement officers' identities and bona fide incident | ||||||
18 | report numbers related to incidents. | ||||||
19 | (c) By January 1 of each year, a manufacturer of any | ||||||
20 | vehicle sold in this State shall prepare an annual written | ||||||
21 | statement detailing the manufacturer's tracking and disabling | ||||||
22 | system capabilities, including, but not limited to, real-time | ||||||
23 | turn-by-turn, interval pinging, slow down, engine cutoff, and | ||||||
24 | alarm or light activation, per model, trim, and year. The | ||||||
25 | manufacturer shall make the annual written statement available | ||||||
26 | to State, county, and local law enforcement agencies upon |

1 | request. A manufacturer shall provide its annual written | ||||||
2 | statement to the requesting law enforcement agency within 30 | ||||||
3 | days after the request. | ||||||
4 | (d) If a vehicle is not subscribed to the manufacturer's | ||||||
5 | tracking service, the manufacturer of any vehicle sold in this | ||||||
6 | State shall waive all fees associated with initiating, | ||||||
7 | renewing, reestablishing, or maintaining the location, | ||||||
8 | disabling, or alert service with which the vehicle is equipped | ||||||
9 | during a law enforcement response or investigation of the | ||||||
10 | specified offenses in subsection (a).
