    Amends the State Treasurer Act. Makes changes concerning banking and teller machine services. Provides that the State Comptroller shall direct and the State Treasurer shall transfer the remaining balance from the Treasurer's Rental Fee Fund into the State Treasurer's Bank Services Trust Fund.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Treasurer Act is amended by changing
5Section 18 as follows:
 
6    (15 ILCS 505/18)
7    Sec. 18. Banking and automated automatic teller machine
8services.
9    (a) The Treasurer may enter into written agreements with
10financial institutions for the provision of banking services
11at the State Capitol and with automated teller machine
12providers for the provision of automated automatic teller
13machine services at State office buildings, State parks, State
14tourism centers, and State fairs at Springfield and DuQuoin.
15The Treasurer shall establish competitive procedures for the
16selection of financial institutions and automated teller
17machine providers to provide the services authorized under
18this Section. No State agency may procure services authorized
19by this Section without the approval of the Treasurer.
20    (b) The Treasurer shall enter into written agreements with
21the authorities having jurisdiction of the property where the
22services are intended to be provided. These agreements shall
23include, but need not be limited to, the quantity of machines

1to be located at the property and the exact location of the
2service or machine and shall establish responsibility for
3payment of expenses incurred in locating the machine or
4service.
5    (c) The Treasurer's agreement with a financial institution
6or automated teller machine providers may authorize the
7financial institution or automated teller machine providers to
8provide any or all of the banking services that the financial
9institution or automated teller machine providers is otherwise
10authorized by law to provide to the public.
11    The Treasurer's agreement with a financial institution or
12automated teller machine providers shall establish the amount
13of compensation to be paid by the financial institution. The
14financial institution or automated teller machine providers
15shall pay the compensation to the Treasurer in accordance with
16the terms of the agreement. The Treasurer shall deposit moneys
17received under this Section into the State Treasurer’s Bank
18Services Trust Fund. Treasurer's Rental Fee Fund, a special
19fund hereby created in the State treasury. The Treasurer shall
20use the moneys in the Fund for the operation of the program
21established under this Section. If the Treasurer determines
22that any moneys in the Treasurer's Rental Fee Fund are in
23excess of the amount necessary to sustain the operation of the
24program established under this Section, the Treasurer may
25transfer any unobligated and unexpended moneys from the
26Treasurer's Rental Fee Fund into the State Pensions Fund.

1    (d) This Section does not apply to a State office building
2in which a currency exchange or a credit union providing
3financial services located in the building on July 1, 1995
4(the effective date of Public Act 88-640) is operating.
5    (e) Notwithstanding any other provision of law to the
6contrary, and in addition to any other transfers that may be
7provided by law, within 30 days of the effective date of this
8amendatory Act of the 103rd General Assembly, or as soon
9thereafter as practicable, the State Comptroller shall direct
10and the State Treasurer shall transfer the remaining balance
11from the Treasurer's Rental Fee Fund into the State
12Treasurer’s Bank Services Trust Fund. Upon completion of the
13transfer, the Treasurer's Rental Fee Fund is dissolved, and
14any future deposits due to that Fund and any outstanding
15obligations or liabilities of that Fund shall pass to the
16State Treasurer’s Bank Services Trust Fund.

18    Section 10. The State Finance Act is amended by changing
19Section 5.397 as follows:

21    Sec. 5.397. The Treasurer's Rental Fee Fund. This Fund is
22dissolved upon the transfer of the remaining balance from the
23Treasurer's Rental Fee Fund to the State Treasurer's Bank
24Services Trust Fund as provided under subsection (e) of

1Section 18 of the State Treasurer Act. This Section is
2repealed on January 1, 2025.

4    Section 15. The State Treasurer's Bank Services Trust Fund
5Act is amended by changing Section 10 as follows:

7    Sec. 10. Creation of Fund. There is hereby created in the
8State treasury a special fund to be known as the State
9Treasurer's Bank Services Trust Fund. Moneys deposited in the
10Fund shall be used by the State Treasurer to pay the cost of
11the following banking services: processing of payments of
12taxes, fees, and other moneys due the State; transactional,
13technological, consultant, legal service charges, and other
14operational expenses of the State Treasurer's Office related
15to the investment or safekeeping of funds under the
16Treasurer's control; the provision of banking and automated
17teller machine services at State office buildings, State
18parks, State tourism centers, and State fairs at Springfield
19and DuQuoin; and the cost of paying bondholders and legal
20services under the State's general obligation bond program.
