AMENDMENT TO HOUSE BILL 2213

2    AMENDMENT NO. ______. Amend House Bill 2213 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Unified Code of Corrections is amended by
5adding Section 3-6-9 as follows:
 
6    (730 ILCS 5/3-6-9 new)
7    Sec. 3-6-9. Treatment for incarcerated individuals with
8substance use disorder.
9    (a) In this Section, "medication-assisted treatment" means
10the prescription of medications that are approved by the
11United States Food and Drug Administration and the Center for
12Substance Abuse Treatment to assist with treatment for a
13substance use disorder and to support recovery for individuals
14receiving services in a facility licensed by the Illinois
15Department of Human Services. "Medication-assisted treatment"
16includes opioid treatment services as authorized by a license

1issued by the Illinois Department of Human Services.
2    (b) Subject to appropriations, the Illinois Department of
3Corrections shall assess each person under the Department's
4care for a substance use disorder, as defined in Section 1-10
5of the Substance Use Disorder Act, using standard diagnostic
6criteria by: (1) a social worker licensed under the Clinical
7Social Work and Social Work Practice Act; (2) a professional
8counselor licensed under the Professional Counselor and
9Clinical Professional Counselor Licensing and Practice Act;
10(3) a psychologist licensed under the Clinical Psychologist
11Licensing Act; (4) a psychiatrist as defined in Section 1-121
12of the Mental Health and Developmental Disabilities Code; or
13(5) a person licensed to provide treatment or intervention
14services under the Illinois Substance Use Disorder Act, acting
15within the scope of practice for which the licensed person is
16credentialed in this State. The Department of Corrections
17shall make available the medication-assisted treatment
18services, consistent with a treatment plan developed by a
19physician licensed to practice medicine in all its branches
20under the Medical Practice Act of 1987. The Department shall
21not impose limitations on the type of medication-assisted
22treatment that may be recommended by a physician.
23    (c) Requirements under this Section shall not be subject
24to an individual's prior success or failure of the services
25provided.
26    (d) The Department may adopt rules for the implementation
