    Amends various Acts relating to the governance of public universities and community colleges in Illinois. Requires the governing board of each public university and community college district to contract for the provision of child care services on campus for its students. Provides that charges for service shall be at a reduced rate or service shall be free of charge, depending on the student's income. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Act is amended by
5changing Section 1d as follows:
 
6    (110 ILCS 305/1d)  (from Ch. 144, par. 22d)
7    Sec. 1d. Child care services.
8    (a) For the purposes of this Section, "child care
9services" means day care home or center services as defined by
10the Child Care Act of 1969.
11    (b) The Board may contract for the provision of child care
12services for its employees and shall contract for the
13provision of child care services on campus for its students.
14The Board may, in accordance with established rules, allow day
15care centers to operate in State-owned or leased facilities.
16Such day care centers shall be primarily for use by State
17employees or students of the university but use by
18non-employees or non-students may be allowed.
19    Where the Board enters into a contract to construct,
20acquire or lease all or a substantial portion of a building, in
21which more than 50 persons shall be employed, other than a
22renewal of an existing lease, after July 1, 1992, and where a
23need has been demonstrated, according to subsection (c),

1on-site child care services shall be provided for employees of
2the university.
3    The Board shall implement this Section and shall
4promulgate all rules and regulations necessary for this
5purpose. By April 1, 1993, the Board shall propose rules
6setting forth the standards and criteria, including need and
7feasibility, for determining if on-site child care services
8for employees shall be provided. The Board shall consult with
9the Department of Children and Family Services in defining
10standards for child care service centers established pursuant
11to this Section to ensure compliance with the Child Care Act of
121969. The Board shall establish a schedule of fees that shall
13be charged for child care services under this Section. The
14schedule shall be established so that charges for service for
15employees are based on the actual cost of care and charges for
16service for students are reduced or service is free of charge,
17depending on the student's income. Except as otherwise
18provided by law for employees who may qualify for public
19assistance or social services due to indigency or family
20circumstance, each employee obtaining child care services
21under this Section shall be responsible for full payment of
22all charges. The Board shall report, on or before December 31,
231993, to the Governor and the members of the General Assembly,
24on the feasibility and implementation of a plan for the
25provision of comprehensive child care services.
26    (c) Prior to contracting for child care services for its

1employees, the Board shall determine a need for child care
2services. Proof of need may include a survey of university
3employees as well as a determination of the availability of
4child care services through other State agencies, or in the
5community. The Board may also require submission of a
6feasibility, design, and implementation plan, that takes into
7consideration similar needs and services for employees of
8other State universities.
9    (d) The Board shall have the sole responsibility for
10choosing the successful bidder and overseeing the operation of
11its child care service program within the guidelines
12established by the Board. The Board shall promulgate rules
13under the Illinois Administrative Procedure Act that detail
14the specific standards to be used in the selection of a vendor
15of child care services.
16    The contract shall provide for the establishment of or
17arrangement for the use of a licensed day care center or a
18licensed day care agency, as defined in the Child Care Act of
191969.

3    Section 45. The Western Illinois University Law is amended
4by changing Section 35-95 as follows:
 
5    (110 ILCS 690/35-95)
6    Sec. 35-95. Child care services.
7    (a) For the purposes of this Section, "child care
8services" means day care home or center services as defined by
9the Child Care Act of 1969.
10    (b) The Board may contract for the provision of child care
11services for its employees and shall contract for the
12provision of child care services on campus for its students.
13The Board may, in accordance with established rules, allow day
14care centers to operate in State-owned or leased facilities.
15Such day care centers shall be primarily for use by State
16employees or students of Western Illinois University but use
17by non-employees or non-students may be allowed.
18    Where the Board enters into a contract to construct,
19acquire or lease all or a substantial portion of a building, in
20which more than 50 persons shall be employed, other than a
21renewal of an existing lease, and where a need has been
22demonstrated, according to subsection (c), on-site child care
23services shall be provided for employees of Western Illinois
24University.

1    The Board shall implement this Section and shall
2promulgate all rules and regulations necessary for this
3purpose. By September 1, 1996, the Board shall propose rules
4setting forth the standards and criteria, including need and
5feasibility, for determining if on-site September child care
6services for employees shall be provided. The Board shall
7consult with the Department of Children and Family Services in
8defining standards for child care service centers established
9pursuant to this Section to ensure compliance with the Child
10Care Act of 1969. The Board shall establish a schedule of fees
11that shall be charged for child care services under this
12Section. The schedule shall be established so that charges for
13service for employees are based on the actual cost of care and
14charges for service for students are reduced or service is
15free of charge, depending on the student's income. Except as
16otherwise provided by law for employees who may qualify for
17public assistance or social services due to indigency or
18family circumstance, each employee obtaining child care
19services under this Section shall be responsible for full
20payment of all charges. The Board shall report, on or before
21December 31, 1996, to the Governor and the members of the
22General Assembly, on the feasibility and implementation of a
23plan for the provision of comprehensive child care services.
24    (c) Prior to contracting for child care services for its
25employees, the Board shall determine a need for child care
26services. Proof of need may include a survey of University

1employees as well as a determination of the availability of
2child care services through other State agencies, or in the
3community. The Board may also require submission of a
4feasibility, design, and implementation plan that takes into
5consideration similar needs and services for employees of
6other State universities.
7    (d) The Board shall have the sole responsibility for
8choosing the successful bidder and overseeing the operation of
9its child care service program within the guidelines
10established by the Board. The Board shall promulgate rules
11under the Illinois Administrative Procedure Act that detail
12the specific standards to be used in the selection of a vendor
13of child care services.
14    The contract shall provide for the establishment of or
15arrangement for the use of a licensed day care center or a
16licensed day care agency, as defined in the Child Care Act of
171969.

19    Section 50. The Public Community College Act is amended by
20adding Section 3-29.26 as follows:

22    Sec. 3-29.26. Child care services for students. A board
23shall contract for the provision of child care services on

1reduced rate or service shall be free of charge, depending on
2the student's income. The contract shall provide for the
3establishment of or arrangement for the use of a licensed day
4care center or a licensed day care agency, as defined in the
5Child Care Act of 1969.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
