AMENDMENT TO SENATE BILL 4018

2    AMENDMENT NO. ______. Amend Senate Bill 4018 as follows:
 
3on page 2, line 20, after "16," by inserting "25.10,"; and
 
4on page 11, immediately below line 5, by inserting the
5following:
 
6    "(225 ILCS 85/25.10)
7    (Section scheduled to be repealed on January 1, 2023)
8    Sec. 25.10. Remote prescription processing.
9    (a) In this Section, "remote prescription processing"
10means and includes the outsourcing of certain prescription
11functions to another pharmacy or licensed non-resident
12pharmacy. "Remote prescription processing" includes any of the
13following activities related to the dispensing process:
14        (1) Receiving, interpreting, evaluating, or clarifying
15    prescriptions.

1        (2) Entering prescription and patient data into a data
2    processing system.
3        (3) Transferring prescription information.
4        (4) Performing a drug regimen review.
5        (5) Obtaining refill or substitution authorizations or
6    otherwise communicating with the prescriber concerning a
7    patient's prescription.
8        (6) Evaluating clinical data for prior authorization
9    for dispensing.
10        (7) Discussing therapeutic interventions with
11    prescribers.
12        (8) Providing drug information or counseling
13    concerning a patient's prescription to the patient or
14    patient's agent, as defined in this Act.
15    (b) A pharmacy may engage in remote prescription
16processing under the following conditions:
17        (1) The pharmacies shall either have the same owner or
18    have a written contract describing the scope of services
19    to be provided and the responsibilities and
20    accountabilities of each pharmacy in compliance with all
21    federal and State laws and regulations related to the
22    practice of pharmacy.
23        (2) The pharmacies shall share a common electronic
24    file or have technology that allows sufficient information
25    necessary to process a non-dispensing function.
26        (3) The records may be maintained separately by each

1    pharmacy or in common electronic file shared by both
2    pharmacies, provided that the system can produce a record
3    at either location that shows each processing task, the
4    identity of the person performing each task, and the
5    location where each task was performed.
6    (c) Nothing in this Section shall prohibit an individual
7employee licensed as a pharmacist, pharmacy technician, or
8student pharmacist from accessing the employer pharmacy's
9database from a pharmacist's home or other remote location or
10pharmacist's home verification for the purpose of performing
11certain prescription processing functions, provided that the
12pharmacy establishes controls to protect the privacy and
13security of confidential records.
