Amends the Illinois Municipal Code. Creates the Municipal Water and Wastewater Funding Study Committee. Provides that the Committee shall study and make recommendations concerning any needed modifications to Illinois Environmental Protection Agency and Illinois Pollution Control Board regulations and policies as they relate to municipal water and wastewater funding to ensure that the State's revolving loan fund programs account for and prioritize the following, to the fullest extent allowed by federal law: (1) a community shall not be deemed ineligible for disadvantaged community status based on size or service area of any size, with regard to special rates, loan terms, and eligibility for loan or grant funds; (2) in determining whether a community is disadvantaged, consideration should be given to impacts of funding on water and wastewater expenses for low-income populations; (3) in determining whether a community is eligible for funds and special rates or loan terms, environmental justice concepts should be considered; (4) in determining how funding is allocated, a community facing water supply shortages should be considered a high priority based on urgency of need; (5) the funding programs should promote formation and implementation of regional water partnerships; and (6) targeted funding should be provided for addressing emerging contaminants, including PFAS. Includes provisions concerning Committee membership and a report of the Committee's findings due no later than January 31, 2023. Repeals the provisions on January 1, 2024. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by |
5 | | adding Section 8-4-27 as follows: |
6 | | (65 ILCS 5/8-4-27 new) |
7 | | Sec. 8-4-27. Municipal Water and Wastewater Funding Study |
8 | | Committee. |
9 | | (a) The Municipal Water and Wastewater Funding Study |
10 | | Committee is established. |
11 | | (b) The following members shall be appointed to the |
12 | | Committee no later than 30 days after the effective date of |
13 | | this amendatory Act of the 102nd General Assembly: |
14 | | (1) Two members appointed by the President of the |
15 | | Senate. |
16 | | (2) Two members appointed by the Minority Leader of |
17 | | the Senate. |
18 | | (3) Two members appointed by the Speaker of the House |
19 | | of Representatives. |
20 | | (4) Two members appointed by the Minority Leader of |
21 | | the House of Representatives. |
22 | | (5) Two members appointed by the Governor. |
23 | | The members shall elect from their number a chair and such |

1 | | other officers as they may choose. The Committee shall meet at |
2 | | the call of the chair. Committee members shall serve without |
3 | | compensation. If a vacancy occurs in the Committee membership, |
4 | | the vacancy shall be filled in the same manner as the original |
5 | | appointment for the remainder of the Committee. |
6 | | (c) The Committee shall study and make recommendations |
7 | | concerning any needed modifications to Illinois Environmental |
8 | | Protection Agency and Illinois Pollution Control Board |
9 | | regulations and policies as they relate to municipal water and |
10 | | wastewater funding to ensure that the State's revolving loan |
11 | | fund programs account for and prioritize the following, to the |
12 | | fullest extent allowed by federal law: |

2 | | implementation of regional water partnerships. |
3 | | (6) Targeted funding should be provided for addressing |
4 | | emerging contaminants, including PFAS. |
5 | | (d) The Committee shall prepare a report that summarizes |
6 | | its work and makes recommendations resulting from its study. |
7 | | The Committee shall submit the report of its findings and |
8 | | recommendations to the Governor and the General Assembly no |
9 | | later than January 31, 2023. Once the Committee has submitted |
10 | | the report to the General Assembly and Governor, the Committee |
11 | | is dissolved. |
12 | | (f) This Section is repealed on January 1, 2024.

13 | | Section 99. Effective date. This Act takes effect upon |
14 | | becoming law.
