AMENDMENT TO SENATE BILL 3851

2    AMENDMENT NO. ______. Amend Senate Bill 3851 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. This Act may be referred to as the Supporting
5Special Needs Students Act.
 
6    Section 5. The School Code is amended by adding Section
72-3.11e as follows:
 
8    (105 ILCS 5/2-3.11e new)
9    Sec. 2-3.11e. Adult students receiving special education
10services; computation of completion rates. The General
11Assembly finds that for the purposes of calculating completion
12rates, certain adult students receiving special education
13services have completed the requirements for graduation and
14are eligible for a diploma with their cohort, but the
15withholding of graduate status at the school level permits a

1continuation of special education services in a population
2that would otherwise have received a standard diploma and be
3considered graduates. Relating to the inclusion of certain
4adult students receiving special education services in the
5computation of completion rates for purposes of public school
6accountability, when computing completion rates under Section
710-17a, the State Superintendent of Education shall include
8students who:
9        (1) are at least 18 years of age as of September 1 of
10    the school year as reported for the fall semester and have
11    satisfied the credit requirements for high school
12    graduation;
13        (2) have not completed their individualized education
14    program in accordance with Section 14-1.02 of this Code
15    and the federal Individuals with Disabilities Education
16    Act (20 U.S.C. Section 1400 et seq.); and
17        (3) are enrolled and receiving individualized
18    education program services.".
