AMENDMENT TO SENATE BILL 3851

2    AMENDMENT NO. ______. Amend Senate Bill 3851 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. This Act may be referred to as the Supporting
5Special Needs Students Act.
 
6    Section 5. The School Code is amended by adding Section
72-3.11e and by changing Section 2-3.25 as follows:
 
8    (105 ILCS 5/2-3.11e new)
9    Sec. 2-3.11e. Adult students receiving special education
10services; computation of completion rates. The General
11Assembly finds that for the purposes of calculating completion
12rates, certain adult students receiving special education
13services have completed the requirements for graduation and
14are eligible for a diploma with their cohort, but the
15withholding of graduate status at the school level permits a

1continuation of special education services in a population
2that would otherwise have received a standard diploma and be
3considered graduates. Relating to the inclusion of certain
4adult students receiving special education services in the
5computation of completion rates for purposes of public school
6accountability, when computing completion rates under Section
710-17a, the State Superintendent of Education shall include
8students who:
9        (1) are at least 18 years of age as of September 1 of
10    the school year as reported for the fall semester and have
11    satisfied the credit requirements for high school
12    graduation;
13        (2) have not completed their individualized education
14    program in accordance with Section 14-1.02 of this Code
15    and the federal Individuals with Disabilities Education
16    Act (20 U.S.C. Section 1400 et seq.); and
17        (3) are enrolled and receiving individualized
18    education program services.

20    Sec. 2-3.25. Standards for schools.
21    (a) To determine for all types of schools conducted under
22this Act efficient and adequate standards for the physical
23plant, heating, lighting, ventilation, sanitation, safety,
24equipment and supplies, instruction and teaching, curriculum,
25library, operation, maintenance, administration and

1supervision, and to issue, refuse to issue or revoke
2certificates of recognition for schools or school districts
3pursuant to standards established hereunder; to determine and
4establish efficient and adequate standards for approval of
5credit for courses given and conducted by schools outside of
6the regular school term.
7    (a-5) On or before July 1, 2021, the State Board of
8Education must adopt revised social science learning standards
9that are inclusive and reflective of all individuals in this
10country.
11    (b) Whenever it appears that a secondary or unit school
12district may be unable to offer courses enabling students in
13grades 9 through 12 to meet the minimum preparation and
14admission requirements for public colleges and universities
15adopted by the Board of Higher Education, the State Board of
16Education shall assist the district in reviewing and analyzing
17its existing curriculum with particular reference to the
18educational needs of all pupils of the district and the
19sufficiency of existing and future revenues and payments
20available to the district for development of a curriculum
21which will provide maximum educational opportunity to pupils
22of the district. The review and analysis may consider
23achievement of this goal not only through implementation of
24traditional classroom methods but also through development of
25and participation in joint educational programs with other
26school districts or institutions of higher education, or

1alternative programs employing modern technological methods
2including but not limited to the use of television,
3telephones, computers, radio and other electronic devices.
4    Beginning with the 2025-2026 school year, in high school
5districts providing transition services in counties with
6populations greater than 800,000 but less than 4,000,000 where
7there are 2 high schools individually serving grades 9 through
812 and where enrollment is less than 2,500 at any school,
9enrollment shall be balanced across high schools within the
10district equally, not to exceed a 15% enrollment difference
11when averaged over the previous 3 consecutive years.
