AMENDMENT TO SENATE BILL 2350




2    AMENDMENT NO. ______. Amend Senate Bill 2350 on page 5, by 
3replacing lines 4 through 7 with the following:


4    "For purposes of this Act, to the extent permitted by and 
5consistent with federal law, "public utility" has the meaning 
6given that term in Section 3-105 of the Public Utilities Act 
7and includes (i) large electing providers as defined in 
8Section 13-406.1 of the Public Utilities Act, (ii) providers 
9of cable service or video service which possess State-issued 
10authorization to offer or provide cable or video service 
11issued under Section 21-401 of the Cable and Video Competition 
12Law of 2007, (iii) providers of wireless services, including, 
13but not limited to, private radio service, public mobile 
14service, or commercial mobile service within the meaning  of 
15Section 332 of the federal Communications Act of 1934 (47 
16U.S.C. 332), and (iv) persons or entities engaged in the 
17installation, repair, or maintenance of fiber optic cable that 
18is or will be used by a large electing provider, a provider of

service or video service that possesses State-issued

2authorization to offer or provide cable or video service

3issued under Section 21-401 of the Cable and Video Competition

4Law of 2007, or a provider of wireless service to provide any
