2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
4 | Section 5. The School Code is amended by changing Section | ||||||||||||||||||||||||||
5 | 10-1 as follows:
| ||||||||||||||||||||||||||
6 | (105 ILCS 5/10-1) (from Ch. 122, par. 10-1)
| ||||||||||||||||||||||||||
7 | Sec. 10-1. Board
of school directors.
| ||||||||||||||||||||||||||
8 | (a) School districts having a population of fewer than | ||||||||||||||||||||||||||
9 | 1000 inhabitants
and
not governed by any special act shall be | ||||||||||||||||||||||||||
10 | governed by a board of school
directors to consist of 3 members | ||||||||||||||||||||||||||
11 | who shall be elected in the manner
provided in Article 9 of | ||||||||||||||||||||||||||
12 | this Act. In consolidated districts and in districts
in which | ||||||||||||||||||||||||||
13 | the membership of the board of school directors is increased | ||||||||||||||||||||||||||
14 | as
provided in subsection (b), 7 members
shall be so elected.
| ||||||||||||||||||||||||||
15 | (b) Upon presentment to the board of school directors of a | ||||||||||||||||||||||||||
16 | school district
having a population of fewer than 1,000 | ||||||||||||||||||||||||||
17 | inhabitants of a petition signed by the
lesser of 5% or 25 of | ||||||||||||||||||||||||||
18 | the registered voters of the district to increase the
| ||||||||||||||||||||||||||
19 | membership of the district's board of school directors to 7 | ||||||||||||||||||||||||||
20 | directors and to
elect a new 7-member board of school | ||||||||||||||||||||||||||
21 | directors to replace the district's
existing board of 3 school | ||||||||||||||||||||||||||
22 | directors, the clerk or secretary of the board of
school | ||||||||||||||||||||||||||
23 | directors shall certify the proposition to the proper election

1 | authorities for submission to the electors of the district at | ||||||
2 | a regular
scheduled election in accordance with the general | ||||||
3 | election law. If the
proposition is approved by a majority of | ||||||
4 | those voting on the proposition, the
members of the board of | ||||||
5 | school directors of that district thereafter shall be
elected | ||||||
6 | in the manner provided by subsection (c) of Section 10-4.

7 | (c) A board of school directors may appoint a student to | ||||||
8 | the board to serve in an advisory capacity. The student member | ||||||
9 | shall serve for a term as determined by the board. The board | ||||||
10 | may not grant the student member any voting privileges, but | ||||||
11 | shall consider the student member as an advisor. The student | ||||||
12 | member may not participate in or attend any executive session | ||||||
13 | of the board.

14 | (d) Each board of school directors shall appoint one | ||||||
15 | nonvoting member who is a teacher employed by the school | ||||||
16 | district under the jurisdiction of the board. If the district | ||||||
17 | has multiple school buildings, the teacher member shall be | ||||||
18 | selected to represent all school buildings in the district. In | ||||||
19 | a multi-building district, the building from which the teacher | ||||||
20 | member is selected shall be determined by lot each year, | ||||||
21 | provided that no building shall twice have selected a teacher | ||||||
22 | member until all buildings in the district have been | ||||||
23 | represented on the board by a teacher member once. The same | ||||||
24 | procedure shall be followed until all buildings have been | ||||||
25 | represented a second time, a third time, and subsequent times. | ||||||
26 | The method of selecting the teacher member shall be determined |

1 | by building-wide teacher referendum. | ||||||
2 | The teacher member shall serve a term of 4 years beginning | ||||||
3 | on April 15 of each year, except that the teacher member | ||||||
4 | initially selected shall serve a term beginning on the date of | ||||||
5 | selection and expiring on the next succeeding June 30. | ||||||
6 | The teacher member shall have the privilege of casting | ||||||
7 | advisory votes. The teacher member shall have all of the | ||||||
8 | privileges of membership, including the right to make and | ||||||
9 | second motions and to attend executive sessions, other than | ||||||
10 | the right to vote. | ||||||

12 | Section 10. The Public Community College Act is amended by | ||||||
13 | changing Section 3-7.24 as follows:

15 | Sec. 3-7.24. Nonvoting board members. | ||||||
16 | (a) Each community college board shall have one non-voting | ||||||
17 | member who is a student
enrolled in the community college | ||||||
18 | under the jurisdiction of the board. One
non-voting student | ||||||
19 | member shall also be selected in multi-campus districts
to | ||||||
20 | represent all campuses in those districts. In multi-campus | ||||||
21 | districts,
the campus from which the member is selected shall | ||||||
22 | be determined by lot
each year provided that no campus shall | ||||||
23 | twice have selected a non-voting
student member until all | ||||||
24 | campuses in the district have once been represented
on the |

1 | district board. The same procedure shall be followed until all | ||||||
2 | campuses
have been represented a second time, a third time, | ||||||
3 | and subsequent times.

6 | beginning on April 15

17 | represent all campuses in the district. In a multi-campus | ||||||
18 | district, the campus from which the member is selected shall | ||||||
19 | be determined by lot each year, provided that no campus shall | ||||||
20 | twice have selected a faculty member until all campuses in the | ||||||
21 | district have been represented on the board by a faculty | ||||||
22 | member once. The same procedure shall be followed until all | ||||||
23 | campuses have been represented a second time, a third time, | ||||||
24 | and subsequent times. The method of selecting the faculty | ||||||
25 | member shall be determined by campus-wide faculty member | ||||||
26 | referendum. Contingent or adjunct faculty may be considered |

1 | along with full-time faculty without regard to part-time | ||||||
2 | status. | ||||||
3 | The faculty member shall serve a term of 4 years beginning | ||||||
