1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The School Code is amended by adding Sections | ||||||
5 | 2-3.182, 10-20.75, and 34-18.67 as follows: | ||||||
6 | (105 ILCS 5/2-3.182 new) | ||||||
7 | Sec. 2-3.182. Annual census of personnel holding school | ||||||
8 | support personnel endorsements. | ||||||
9 | (a) In this Section: | ||||||
10 | "Pupil-to-school support personnel ratio" means the total | ||||||
11 | number of students in a school district divided by the total | ||||||
12 | number of school support personnel in each endorsement area | ||||||
13 | providing services to students in that school district. | ||||||
14 | "School support personnel endorsement" means an | ||||||
15 | endorsement affixed to a Professional Educator License as | ||||||
16 | referenced in subparagraph (G) of paragraph (2) of Section | ||||||
17 | 21B-25 of this Code. | ||||||
18 | "Special education joint agreement" means an entity formed | ||||||
19 | pursuant to Section 10-22.31 of this Code. | ||||||
20 | (b) Not later than January 1, 2023 and annually | ||||||
21 | thereafter, the State Board of Education must make available | ||||||
22 | on its website the following information for each school | ||||||
23 | district as of November 1st of each year beginning in 2022: |

1 | (1) The total number of personnel with a school | ||||||
2 | support personnel endorsement and, for each endorsement | ||||||
3 | area: | ||||||
4 | (A) those actively employed on a full-time basis | ||||||
5 | by the school district; | ||||||
6 | (B) those actively employed on a part-time basis | ||||||
7 | by the school district; | ||||||
8 | (C) those actively employed by a special education | ||||||
9 | joint agreement providing services to students in the | ||||||
10 | school district; and | ||||||
11 | (D) individuals who are not full-time or part-time | ||||||
12 | employees of the school district or of a special | ||||||
13 | education joint agreement who provide school support | ||||||
14 | services to students in the school district under a | ||||||
15 | contract with the individuals or with an agency or | ||||||
16 | organization that employs the individuals. | ||||||
17 | (2) The pupil-to-school support personnel ratio | ||||||
18 | disaggregated by (i) school support personnel endorsement | ||||||
19 | area and (ii) students with an individualized education | ||||||
20 | program or a plan pursuant to Section 504 of the federal | ||||||
21 | Rehabilitation Act of 1973 and students without an | ||||||
22 | individualized education program or a plan pursuant to | ||||||
23 | Section 504 of the federal Rehabilitation Act of 1973. | ||||||

25 | Sec. 10-20.75. School support personnel reporting. No |

1 | later than November 16, 2022 and each November 16th annually | ||||||
2 | thereafter, each school district must report to the State | ||||||
3 | Board of Education the information with regard to the school | ||||||
4 | district as of November 1st of each year beginning in 2022 as | ||||||
5 | described in subsection (b) of Section 2-3.182 of this Code | ||||||
6 | and must make that information available on its website. | ||||||
7 | (105 ILCS 5/34-18.67 new) | ||||||
8 | Sec. 34-18.67. School support personnel reporting. No | ||||||
9 | later than November 16, 2022 and each November 16th annually | ||||||
10 | thereafter, the school district must report to the State Board | ||||||
11 | of Education the information with regard to the school | ||||||
12 | district as of November 1st of each year beginning in 2022 as | ||||||
13 | described in subsection (b) of Section 2-3.182 of this Code | ||||||
14 | and must make that information available on its website.
