AMENDMENT TO SENATE BILL 805 




2    AMENDMENT NO. ______. Amend Senate Bill 805 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The School Code is amended  by adding Section 
52-3.182 as follows:
 
6    (105 ILCS 5/2-3.182 new)
7    Sec. 2-3.182. School unused food sharing plan. School 
8districts shall incorporate a food sharing plan for unused 
9food into their local wellness policy under Section 2-3.139.  
10The food sharing plan shall focus on needy students, with the 
11plan being developed and supported jointly by the district's 
12local health department. Participants in the child nutrition 
13programs, the National School Lunch Program and National 
14School Breakfast Program, the Child and Adult Care Food 
15Program (CACFP), and the Summer Food Service Program (SFSP) 
16shall adhere to the provisions of the Richard B. Russell

1National School Lunch Act, as well as accompanying guidance 
2from the U.S. Department of Agriculture on the Food Donation 
3Program, to ensure that any leftover food items are properly 
4donated in order to combat potential food insecurity in their 
5communities. For the purpose of this Section, "properly" means 
6in accordance with all federal regulations and State and local 
7health and sanitation codes.
 

8    Section 99. Effective date. This Act takes effect upon 
9becoming law.".
