| 1 | | AN ACT concerning finance.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Procurement Code is amended by |
| 5 | | adding Section 30-55 as follows:
|
| 6 | | (30 ILCS 500/30-55 new) |
| 7 | | Sec. 30-55. Construction contracts involving nonmarket |
| 8 | | economy countries. |
| 9 | | (a) Notwithstanding any provision of law to the contrary, |
| 10 | | no procurement contract for the construction, alteration, |
| 11 | | operation, repair, maintenance, or improvement of any mass |
| 12 | | transit facility, or equipment thereof, in excess of |
| 13 | | $1,000,000 shall be awarded to or executed with any vendor |
| 14 | | that receives support from a nonmarket economy country as |
| 15 | | defined in section 7781(18) of the Tariff Act of 1930 (19 |
| 16 | | U.S.C. 1677 (18)) and was identified by the United States |
| 17 | | Trade Representative in the most recent report required by |
| 18 | | section 182 of the Trade Act of 1974 (19 U.S.C. 2242) as a |
| 19 | | priority foreign country, and is subject to monitoring by the |
| 20 | | United States Trade Representative under section 306 of the |
| 21 | | Trade Act of 1974 (19 U.S.C. 2416). |
| 22 | | (b) Nothing in this Section is intended to contravene any |
| 23 | | existing treaties, laws, trade agreements, or regulations of |
