Provides that if and only if Senate Bill 1510 of the 101st General Assembly becomes law, then the Medical Assistance Article of the Illinois Public Aid Code is amended by making a provision that concerns the DCFS per diem rates for inpatient psychiatric stays operative through July 1, 2023 (rather than through June 30, 2021). Effective immediately or on the date Senate Bill 1510 of the 101st General Assembly takes effect, whichever is later.

1 | | AN ACT concerning public aid.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. If and only if Senate Bill 1510 of the 101st |
5 | | General Assembly becomes law, then the Illinois Public Aid |
6 | | Code is amended by changing Section 5-5.07 as follows: |
7 | | (305 ILCS 5/5-5.07) |
8 | | Sec. 5-5.07. Inpatient psychiatric stay; DCFS per diem |
9 | | rate. The Department of Children and Family Services shall pay |
10 | | the DCFS per diem rate for inpatient psychiatric stay at a |
11 | | free-standing psychiatric hospital effective the 11th day when |
12 | | a child is in the hospital beyond medical necessity, and the |
13 | | parent or caregiver has denied the child access to the home and |
14 | | has refused or failed to make provisions for another living |
15 | | arrangement for the child or the child's discharge is being |
16 | | delayed due to a pending inquiry or investigation by the |
17 | | Department of Children and Family Services. If any portion of |
18 | | a hospital stay is reimbursed under this Section, the hospital |
19 | | stay shall not be eligible for payment under the provisions of |
20 | | Section 14-13 of this Code. This Section is inoperative on and |
21 | | after July 1, 2021. Notwithstanding the provision of Public |
22 | | Act 101-209 stating that this Section is inoperative on and

23 | | after July 1, 2020, this Section is operative from July 1, 2020 |
