SYNOPSIS AS INTRODUCED:
 
210 ILCS 55/2.09

    Amends the Home Health, Home Services, and Home Nursing Agency Licensing Act. Provides that "home services" includes assistance with: bathing without client self-direction, including areas of the body other than those areas with special skin care needs; applying topical prescription lotions to rashes, skin tears, stage 1 or 2 decubiti, and first and second degree burns; applying compression stockings; assisting with normal feeding, including pre-measured, thickened liquids; applying shampoo in hair care treatment requiring a prescription; permitting nail filing of clients with conditions that might involve peripheral circulatory conditions; assisting with personal, mechanical, or electronic transfers of clients when the client can assist with transfer; assisting with ambulation of clients using adaptative equipment for ambulation; assisting with changing oxygen tanks, adjusting oxygen flow, and turning oxygen tanks on and off; and repositioning clients every 2 hours or as instructed by the plan of care.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Home Health, Home Services, and Home
5Nursing Agency Licensing Act is amended by changing Section
62.09 as follows:
 
7    (210 ILCS 55/2.09)
8    Sec. 2.09. "Home services" or "in-home services" means
9assistance with activities of: daily living; , housekeeping; ,
10personal laundry; bathing without client self-direction,
11including areas of the body other than those areas with
12special skin care needs; applying topical prescription lotions
13to rashes, skin tears, stage 1 or 2 decubiti, and first and
14second degree burns; applying compression stockings; assisting
15with normal feeding, including pre-measured, thickened
16liquids; applying shampoo in hair care treatment requiring a
17prescription; permitting nail filing of clients with
18conditions that might involve peripheral circulatory
19conditions; assisting with personal, mechanical, or electronic
20transfers of clients when the client can assist with transfer;
21assisting with ambulation of clients using adaptative
22equipment for ambulation; assisting with changing oxygen

2the plan of care; , and providing companionship provided to an
3individual in his or her personal residence, which are
4intended to enable that individual to remain safely and
5comfortably in his or her own personal residence. "Home
6services" or "in-home services" does not include services that
7would be required to be performed by an individual licensed
8under the Nurse Practice Act.
