4 | | the Rules of the House of Representatives of the 102nd General |
5 | | Assembly are amended by changing Rules 52 and 59 as follows:

6 | | (House Rule 52)
|
7 | | 52. Debate.
|
8 | | (a) All legislative measures,
except
those legislative |
9 | | measures that are not debatable as provided in these Rules,
|
10 | | are subject to a debate status as follows:
|
11 | | (1) Short Debate: Debate is limited to a 2-minute
|
12 | | presentation by the Principal Sponsor or a member |
13 | | designated by the
Principal Sponsor, a 2-minute |
14 | | presentation by a member in response,
and one minute for |
15 | | the Principal Sponsor to close debate, or yield to other
|
16 | | members; provided that at the request of 7 members before |
17 | | the close of debate,
the debate status shall be opened to |
18 | | standard debate; or
|
19 | | (2) Standard Debate: Debate shall consist of a |
20 | | 10-minute
presentation by the Principal Sponsor or a |
21 | | member designated by the
Principal Sponsor, debate by each |
22 | | proponent and member in
response
who seeks recognition, |
23 | | and 5 minutes for the Principal Sponsor to
close debate, |

17 | | proponent and member in

18 | | and 5 minutes for the Principal Sponsor to
close debate, |

20 | | (5) Amendment Debate: Debate on floor amendments

debate by one proponent, debate by each of 2

minutes for the Principal |
26 | | Sponsor to close debate, or yield to other members.

1 | | No debate is in order on bills or resolutions on the order |
2 | | of First Reading
or Second Reading, except for debate on floor |
3 | | amendments as provided in this
Rule.

4 | | (b) All legislative measures, except those assigned to the |
5 | | Consent Calendar or , those assigned short debate status by a |
6 | | standing or special committee, and floor amendments, referred |
7 | | to the House
from a committee, or discharged from a committee, |
8 | | are
automatically
assigned standard debate status , subject to |
9 | | subsection
(c) of
this Rule . A bill, resolution, or joint |
10 | | action motion for final action shall be given short debate |
11 | | status by report of the committee if the bill or resolution was |
12 | | favorably reported by a three-fifths vote of the members |
13 | | present and voting, including those voting "present" , subject |
14 | | to subsection (c) of this Rule. All floor amendments referred
|
15 | | to the House from a committee,
or discharged from a committee, |
16 | | are automatically assigned amendment
debate
status, subject to |
17 | | subsection (c) of this Rule .
|
18 | | (c) (blank.) Notwithstanding any other provision of these |
19 | | Rules
to the contrary (except Rule 44), the debate status of |
20 | | any legislative measure may be changed
only (i) by the |
21 | | Speaker, as defined in item (27) of Rule 102, by filing a
|
22 | | notice with the Clerk, or (ii) by the Rules Committee
by motion |
23 | | approved by a majority of those appointed. While a legislative
|
24 | | measure is being considered by the House, the debate status |
25 | | may also be
changed by unanimous consent. No legislative |
26 | | measure, however, may be
placed on the Consent Calendar under |

1 | | this Rule.
No legislative measure, except a floor amendment, |
2 | | may be assigned amendment
debate status under this Rule.
|
3 | | (d) (blank.) The Speaker or Rules Committee, as the case |
4 | | may be, shall notify the
Clerk of any action
to change the |
5 | | debate status of any legislative measure. The Clerk shall |
6 | | cause
that
information to be reflected on the Daily Calendar |
7 | | on subsequent legislative
days,
provided
the legislative |
8 | | measure is still before the House.
|
9 | | (e) No member shall speak longer than 5 minutes at one
time |
10 | | or more than once on the same question except by leave
of the |
11 | | House. The Principal Sponsor of a measure or a member
|
12 | | designated by the Principal Sponsor, however, shall be
allowed |
13 | | to open the debate and to close the debate
in accordance with |
14 | | subsection (a) of this Rule. The provisions of this
subsection |
15 | | (e)
are subject to and limited by subsections (a) and , (b) , and |
16 | | (c) of this Rule.
A member may yield to another member the time |
17 | | allotted for the member's debate.
|
18 | | (f) The Presiding Officer shall allocate the debate on |
19 | | each legislative
measure alternately, if possible,
between |
20 | | proponents and opponents of the legislative
measure
under |
21 | | debate.
|
22 | | (g) This Rule may not be suspended.

25 | | 59. Previous Question.
|

1 | | (a) A motion for the previous question may be made at
any |
2 | | time, except that a member may not move the previous question |
3 | | while participating in debate pursuant to Rule 52. A motion |
4 | | for the previous question is not
debatable and requires the |
5 | | unanimous consent of the members present or the affirmative |
6 | | vote of two-thirds of the 60 members
elected. A record vote |
7 | | must be taken on the motion if unanimous consent has been |
8 | | denied. This subsection may not be suspended.
|
9 | | (b) The previous question shall be stated in the
following |
10 | | form: "Shall the main question be put?"
Until the previous |
11 | | question is decided, all amendments and
debate are precluded. |
12 | | When it is decided that the main
question shall not be put, the |
13 | | main question
remains under debate.
|
14 | | (c) The effect of the main question being ordered is
to put |
15 | | an end to all debate and bring the House to a
direct vote on |
16 | | the immediately pending motion. After a
motion for the |
17 | | previous question has been approved, it
is not in order to move |
18 | | for adjournment or to make any
other motion before a decision |
19 | | on the main question.

20 | | (d) This Rule may be suspended only by the affirmative |
21 | | vote of 71
members elected.
