605 ILCS 5/6-201.7  from Ch. 121, par. 6-201.7

     Amends the Illinois Highway Code. In provisions concerning the performance of functions by the highway commissioner of a road district, provides that, except for professional services, when the cost of construction, materials, supplies, new machinery or equipment exceeds $30,000 (instead of $20,000), the contract for such construction, materials, supplies, machinery or equipment shall be let to the lowest responsible bidder if specified conditions are met. Effective immediately.

1    AN ACT concerning transportation.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Highway Code is amended  by 
5changing Section 6-201.7 as follows:

7    Sec. 6-201.7. Construct, maintain and repair and be 
8responsible for
the construction, maintenance and repair of 
9roads within the district,
let contracts, employ labor and 
10purchase material and machinery
therefor, subject to the 
11limitations provided in this Code.
Contracts,
labor, 
12machinery, disposal, and incidental expenses related to 
13special services
under Section 6-201.21 of this Code 
14constitute maintenance, for purposes of
this Section.

15    Except for professional services, when the cost of 
16construction,
materials, supplies, new machinery or equipment 
17exceeds $30,000
$20,000, the
contract for such construction, 
18materials, supplies, machinery or
equipment shall be let to

19the lowest responsible bidder after advertising for bids at 
20least once,
and at least 10 days prior to the time set for the 
21opening of such bids, in a
newspaper
published within the 
22township or road district, or, if no newspaper is
published 
23within the township or road district then in one published

1within the county, or, if no newspaper is published within the 
2county
then in a newspaper having general circulation within 
3the township or
road district, but, in case of an emergency, 
4such contract may be let
without advertising for bids.  For 
5purposes of this
Section "new machinery or equipment" shall be 
6defined as that which has
been previously untitled or that 
7which shows fewer than 200 hours on its
operating clock and 
8that is accompanied by a new equipment manufacturer's

9warranty.

12    Section 99. Effective date. This Act takes effect upon 
13becoming law.
