SYNOPSIS AS INTRODUCED:
 
35 ILCS 200/15-190 new

    Amends the Property Tax Code. Provides that no county employee or county official shall publicly disclose on an Internet website information concerning whether particular property has been granted a homestead exemption based on an individual's status as a person with a disability if the county receives a written request from the person with a disability or from that person's authorized agent or representative to refrain from disclosing that information. Provides that the information shall be removed from the Internet website within 5 business days after the request. Provides for an action in the circuit court seeking injunctive or declaratory relief to enforce the provisions of the amendatory Act.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Property Tax Code is amended by adding
5Section 15-190 as follows:
 
6    (35 ILCS 200/15-190 new)
7    Sec. 15-190. Limitations on posting disability status.
8    (a) No county employee or county official shall publicly
9disclose on an Internet website information concerning whether
10particular property has been granted a homestead exemption
11under this Code based on an individual's status as a person
12with a disability if the county receives a written request to
13refrain from disclosing that information from the person with
14a disability or from that person's authorized agent or
15representative. Any publicly available information the
16disclosure of which is prohibited by this Section shall be
17removed from the Internet website within 5 business days after
18the county receives a written request under this Section.
19After the information has been removed, no county employee or
20county official shall publicly post or display the information
21described in this Section unless the county receives written
22authorization from the individual with a disability to make
23that information available to the public.

1    (b) A property owner whose homestead exemption status is
2publicly disclosed in violation of this Section may bring an
3action in the circuit court seeking injunctive or declaratory
4relief prohibiting disclosure of information concerning the
5individual's status as a person with a disability.
