| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Municipal Code is amended by |
| 5 | | adding Section 11-150-3 as follows:
|
| 6 | | (65 ILCS 5/11-150-3 new) |
| 7 | | Sec. 11-150-3. Water reconnection fee. |
| 8 | | (a) A municipally owned water utility may not charge a fee |
| 9 | | to reconnect water following a water disconnection. |
| 10 | | (b) The charging of water reconnection fees are exclusive |
| 11 | | powers and functions of the State. A home rule or non-home rule |
| 12 | | municipality may not charge a water reconnection fee. This |
| 13 | | Section is a denial and limitation of home rule powers and |
| 14 | | functions under subsection (h) of Section 6 of Article VII of |
| 15 | | the Illinois Constitution.
